The business discussed problematic issues related to customs formalities at the Odesa customs
On January 25, 2022, EBA member-companies took part in a meeting of the management of the Odesa Customs of the State Customs Service with business.
This time the business community of the Association in the region outlined the following important issues: cancellation of the illegal decision to adjust the customs value of goods; customs clearance of tobacco in the framework of the Free Trade Agreement with the Republic of Northern Macedonia; introduction of electronic order for export cargo; receiving clear explanations from the Administrative Department of Odesa Customs regarding the issuance of goods stored in the warehouse of the customs authority; adjustment sheets, if they are sent to the broker in electronic form, unclaimed cargoes and their movement, unlocking the amount of guarantees on previous declarations on which the cargo was not passed. Some issues do not lose their relevance. In particular, in December, during the dialogue with the heads of the company’s departments, the companies focused on statistics on the time of customs clearance, efficiency and organizational aspects of launching the Electronic Journal of the maritime checkpoint, etc.
According to the representatives of the Odesa customs, it was emphasized that to date an inventory of dependent goods has been carried out and the goods to be transferred to the warehouse of the customs authority have been identified, as well as work on warehouses in the area of activity of “Odesa-port” customs post and “Chornomorsk-port” customs post, warehouses have already been determined, information on goods to be transferred to the destruction regime has been determined. To unblock tax invoices for which no cargo was passed, they received a recommendation to apply to the Ministry of Finance of Ukraine so that they can be unlocked automatically.
Also drew attention of the business to the Draft Law of Ukraine “On Amendments to the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine on Criminalization of Smuggling of Goods and Excisable Goods and Inaccurate Declaration of Goods” № 5420, in particular Article 201-4 of the Criminal Code of Ukraine on Inaccurate Declaration goods, which allows for the possibility of criminal prosecution even for unintentional errors in customs declarations.
