Business discussed updates to labor legislation

  Yesterday, the European Business Association held a meeting with representatives of the Ministry of Economy of Ukraine. The meeting was attended by Tetiana Berezhna, Deputy Minister of the Economy of Ukraine, and Oleh Hnatyuk, Deputy Director of the Labor Department – Head of the Department of State Policy on Labor Issues at the Ministry of Economy. Currently, the working group at the Ministry of Economy is continuing its work on the draft of a new Labor Code. This new code is set to replace the current Labor Code, which was adopted in 1971 and no longer aligns with modern realities. Numerous proposals and comments from key stakeholders have already been considered in the drafting process, and the Ministrys team invited business representatives to join the discussion. The goal is to develop a shared vision for the necessary solutions and changes in labor legislation that will improve the regulation of relations between employers and employees. During the meeting, the focus was on types of labor contracts, mechanisms for resolving labor disputes, and issues regarding working hours and vacations. The updated Labor Code proposes the introduction of the following types of labor contracts: indefinite and fixed-term employment contracts, remote work contracts, home-based work contracts, contracts with unfixed working hours, seasonal work contracts, apprenticeship contracts, and contracts with domestic workers. Each of these contracts has specific application features, which were discussed at the meeting. The discussion also covered labor dispute resolution, labor inspections, and the importance of utilizing electronic HR documentation, which was emphasized by the business representatives. The participants agreed that EBA member companies can submit their suggestions and comments on the draft document to the Association by September this year. The Ministry of Economy will then review and consider all proposals in the finalization of the document.
