Court of Appeal Upheld the Anti-Dumping Duty Imposed on the Import of Gas-Concrete Blocks from Belarus

  On 18 June 2021, the Sixth Administrative Court of Appeal upheld the decision of the District Administrative Court of Kyiv, by which the Belarusian manufacturers of gas-concrete blocks – Republican Manufacturing and Trade Unitary Enterprise Management Company of Belarusian Cement Company Holding and the importer BK Komfort-Bud LTD LLC – were refused to lift the anti-dumping duty imposed on the import of goods to Ukraine. In these proceedings, Ilyashev & Partners Law Firm represented the interests of members of the Ukrainian Autoclaved Aerated Concrete Producers Association (VAAG). Thus, the Court of Appeal recognized the need to protect the national manufacturers of autoclaved gas concrete from the dumping imports of goods exported to Ukraine by Belarusian manufacturers. It is to be recalled that on 2 March 2021, the District Administrative Court of Kyiv refused to satisfy the claims of Belarusian manufacturers of gas-concrete blocks for the lifting of the anti-dumping duty imposed on the import into Ukraine of gas-concrete blocks originating in the Republic of Belarus. By its decision No. AD-437/2020/4411-03 dated 21 February 2020, the Interdepartmental Commission on International Trade imposed the final anti-dumping duty at the level of 34.19%. The project was handled by Partner Olena Omelchenko, Counsel Valeriia Gudiy and Attorney at Law Oleksiy Gorbatyuk.
