  In August 2025, the Cabinet of Ministers of Ukraine adopted Resolution No. 976 “On Amendments to the Radio Frequency Spectrum Allocation and Use Plan in Ukraine”. The changes, inter alia, introduced the possibility of using the 5945–6425 MHz frequency band for broadband wireless access, which is an important step for the development of modern wireless technologies, including Wi-Fi 6E, and was supported by the EBA. At the same time, experts of the Association’s Consumer Electronics Committee identified a number of technical inaccuracies in the Plan. In particular, for the 5945–6425 MHz frequency band, the standard ETSI EN 302 687 was indicated, which in fact does not exist. In accordance with ECC/DEC/(20)01 and Commission Implementing Decision (EU) 2021/1067, the applicable standard should be ETSI EN 303 687. In addition, the Plan did not reference ETSI EN 300 440 for the 5725–5850 MHz frequency band, which is used for certain types of radio equipment. Such inaccuracies could have created regulatory obstacles to the placing of relevant equipment on the Ukrainian market. In order to address these issues, the Association’s Committee submitted an official appeal to the Ministry of Digital Transformation of Ukraine and the National Commission for the State Regulation of Electronic Communications, Radio Frequency Spectrum and Postal Services. In its appeal, the Association proposed to: replace ETSI EN 302 687 with ETSI EN 303 687 for the 5945–6425 MHz frequency band in line with European regulatory acts; include ETSI EN 300 440 in the list of applicable standards for the 5725–5850 MHz frequency band. On 25 February 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 262 “On Amendments to Section 2 of the Radio Frequency Spectrum Allocation and Use Plan in Ukraine”, taking into account the Association’s proposals. The adopted amendments will facilitate the harmonisation of Ukrainian regulation with European legislation and create more favourable conditions for the use of modern wireless technologies, including Wi-Fi 6E, as well as for the supply of relevant equipment to the Ukrainian market. The European Business Association is grateful to the Ministry of Digital Transformation, the National Commission for the State Regulation of Electronic Communications, and other relevant authorities for taking business positions into account and for maintaining a constructive dialogue.
