  On January 15, Law of Ukraine No. 4147-IX “On State Regulation in the Field of Plant Protection” was returned with the President’s signature. According to its transitional and final provisions, the Law will come into force three years after its publication, approximately from mid-January 2028. The European Business Association welcomes the introduction of European regulatory principles in the field of plant protection and appreciates the consideration of proposals from the Association’s committees during the development of this significant legal framework. This Law is comprehensive, aligning Ukraine’s legislation fully or partially with several EU directives and regulations, as well as FAO standards, including: Directive No. 2009/128/EC on the sustainable use of pesticides Regulation (EC) No. 1107/2009 on the placing of plant protection products on the market Regulation (EC) No. 1272/2008 on classification, labelling, and packaging of substances and mixtures Regulation (EU) No. 2016/2031 on protective measures against plant pests International Standards for Phytosanitary Measures (ISPM) However, the adoption of this Law is only the first step toward establishing new rules for the entire agricultural production chain. During the transitional period, the Verkhovna Rada of Ukraine must amend several Ukrainian codes. This includes the Criminal Code, where proposed changes aim to criminalise the production, sale, and handling of counterfeit plant protection products—a move fully supported by the business community. Amendments to the Code of Administrative Offences and the Customs Code of Ukraine are also necessary. Moreover, the Law requires the development and adoption of dozens of subordinate acts, both at the Cabinet of Ministers level and within relevant ministries and agencies. EBA experts are ready to contribute to the drafting of these acts to ensure the effective implementation of European legislation in Ukraine.
