  The Government Approved Regulations for the Implementation of Electronic Traceability of Alcoholic Beverages and Tobacco Products On October 4, 2024, the Government approved three important regulatory acts within the framework of implementing electronic traceability for alcoholic beverages, tobacco products, and liquids used in electronic cigarettes. Specifically, these documents define: The procedure for drafting and the form of the excise electronic document; The procedure for generating extracts, the form of the extract, as well as the procedure for creating and operating, and the procedure for forming the Electronic System for Circulation of Alcoholic Beverages, Tobacco Products, and Liquids Used in Electronic Cigarettes; Requirements for the algorithm and criteria for forming a unique group identifier. These acts were adopted in compliance with the requirements of the Ukrainian Tax Code and the Law of Ukraine On State Regulation of the Production and Circulation of Ethyl Alcohol, Alcoholic Distillates, Bioethanol, Alcoholic Beverages, Tobacco Products, Tobacco Raw Materials, Liquids Used in Electronic Cigarettes, and Fuel. Experts from the European Business Association actively participated in the discussion of these documents, providing suggestions for improving regulations and comments regarding the specifics of market operators activities. Special thanks for active involvement are expressed to the leadership of the Committee on Import and Trade of Alcoholic Beverages. We are grateful to the government, particularly the Ministry of Digital Transformation, for taking into account the proposals of the business community. At the same time, we believe it is necessary to emphasize that the introduction of the new system and the test period requires additional time for businesses to properly adapt to the new regulatory requirements. There remains a need for the adoption of other regulatory acts necessary for the full functioning of the system, as well as the development of technical requirements for working with the electronic system. Given this, it will be tough for businesses to implement the system within the timeframe stipulated by law. Therefore, the Associations experts are requesting to postpone its implementation by at least nine months to allow market participants to complete the necessary technical setups, integrations, and compliance with all new regulatory requirements.
