  The Association welcomes the adoption of Draft Law No. 6134 by the Verkhovna Rada of Ukraine on June 10th of this year and its signing by the President of Ukraine on July 5th of this year as the Law of Ukraine On Consumer Rights Protection No. 3153-IX dated June 10, 2023. The adoption of the new Law on Consumer Rights Protection, harmonized with European directives, is an important step for Ukraine and will contribute to the development of a fair and competitive market, ensuring consumer rights and interests. Law No. 3153-IX was developed based on European Union directives (including, but not limited to, Regulation (EU) No. 2017/2394, Directives No. 2013/11/EU, No. 2011/83/EU, No. 2009/22/EU), and its adoption is an important step towards fulfilling our European integration commitments. Moreover, implementing standards and rules that comply with international norms will promote attracting foreign investments and developing external economic relations. Additionally, the adoption of the new Law on Consumer Rights Protection is an important step for both businesses and consumers. The new law is of great significance to consumers as it guarantees their rights and interests when purchasing goods and services. For businesses, Law No. 3153-IX also holds significant importance. It regulates e-commerce matters, lays the foundation for further digitalization, such as allowing the issuance of warranty certificates and certain other documents in electronic form, and more. Additionally, the new law will stimulate competition and enhance the quality of goods and services, as companies will be obliged to adhere to the established rules and standards. At the same time, businesses emphasize the importance of further work on improving legislative norms in the field of consumer rights protection. During the consideration of this draft law in the Committee of the Verkhovna Rada of Ukraine on Economic Development, an agreement was reached to create a working group with the participation of representatives from the Association to develop a separate bill that will take effect together with Law No. 3153-IX (one year after its official publication, but not earlier than the end of martial law). This separate bill will regulate fine-related issues, the duration of warranty repairs, and certain aspects of product labeling in accordance with the practices existing in EU member countries today. Therefore, the Association expects the establishment of the appropriate working group and is ready to continue working towards creating a consumer rights protection system in Ukraine in line with EU norms and practices.
