  Mandatory automated emissions monitoring is postponed for the post-war period On March 28, 2023, at a meeting of the Government, the CMU resolution On approval of the Procedure for the introduction of mandatory automated pollutant emission control systems No. 272 was approved. This document, which comes into effect after the termination/cancellation of martial law, envisages, in particular, the provision of automated monitoring of emissions at new stationary sources in certain types of activities for 5 years. In addition, for installations with a limited period of operation, as well as some others, the option is provided not to carry out automated emission measurements. For the first time, the draft resolution of the Cabinet of Ministers was published for public discussion in October 2022. In its letter, the Association drew the attention of the developers of the document to the economic impracticality of introducing automated monitoring, including at outdated, unmodernized facilities in wartime, given the constant threat of missile strikes and destruction of facilities. Also, a number of provisions that could have caused discretionary powers of authorities and potential corruption risks were excluded from the document. The business community is thankful for taking into account the opinion of enterprises. At the same time, we hope that after the adoption of the draft law in the field of industrial pollution reform, amendments will be made to Resolution No. 272 of the CMU in order to harmonize it with Directive 2010/75/EU, according to which the requirements for the installation of automated control systems are defined exclusively in the conclusions of the best available technologies and methods management (NDTM) and only for a specified list of installations.
