  On 22nd September 2016 the Verkhovna Rada of Ukraine adopted a Draft Law “On National Commission for State Regulation of Energy and Utilities [NERC]” #2966-d dated 19 February 2016. The EBA supported and provided proposals to the Draft Law in terms of the competence of NERC members, its functions and authority, special aspects of the appointing and termination for authority and legal status of NERC members, as well as responsibilities for breaching legislation in the field of energy and utilities. Business-community sincerely congratulates all market-players on occasion of this vitally draft law adoption, which is also a part of Ukraine`s obligations on the Third Energy Package of the European Union. The EBA is looking forward to adopting the Draft Law and setting a ground for a truly independent energy and utilities regulator, fair competition and reasonable tariffs for ultimate consumer. Legal background: The Draft Law “On National Commission for State Regulation of Energy and Utilities [NERC]” #2966-d dd. 19.02.2016 (Draft Law #2966-d).” The Draft Law #2966-d was elaborated in compliance with Ukraine`s obligations as a party of the Treaty establishing the Energy Community (effective for Ukraine from 01.02.2011), due to the Explanatory note. On 22nd September 2016 the Draft Law #2966-d was adopted in the Verkhovna Rada of Ukraine in a second reading and as a whole.
