Demonstration equipment is not obliged to meet the requirements of the technical regulations The EBA received official clarifications from the Ministry of Economic Development, Trade and Agriculture of Ukraine regarding the demonstration of equipment that does not meet the requirements of Ukrainian technical regulations. The EBA members had a number of questions about the specifics of the application of technical regulations to the so-called demonstration equipment that can be presented during fairs, exhibitions, or similar events without putting such equipment into circulation and, accordingly, without bringing such equipment into compliance with adopted technical regulations, e.g. issuance of declarations of conformity, labeling, etc. The Ministry confirmed the correctness of our understanding that if such equipment is not supplied for distribution or use in Ukraine during an exhibition or fair, accordingly such equipment will not be considered as put into circulation and must not meet the requirements of Ukrainian technical regulations. In addition, the Ministry provided further clarification on the specifics of the use of demonstration equipment as a model for trade negotiations, as well as its use for demonstration experiments and development. We are grateful to the Ministry for detailed answers and hope for further constructive cooperation on the harmonization of the technical regulation sphere in Ukraine in accordance with EU Directives.
