Odesa Legal issues

18/ 10/ 2022
From September 1, a new service on the Diia portal - eTrip system’ was expected to start in Ukraine. eTrip” mechanism meant that Ukrainian businessmen and company representatives would be able to travel abroad for a period of 7 days, subject to compliance with a few criteria and etc. However, this mechanism did’t begin to work was returned for revision. On October 13, 2022, an online meeting Traveling abroad during the war organized by the Legal Committee of the EBA Southern Ukrainian Office of the European Business Association was held. Speakers of the event - lawyers from the GOLAW law firm Nataliia Matviichuk and Anastasiia Klian discussed the main issues and peculiarities of traveling abroad and shared current court practice. In particular, the issues of border crossing by reserved workers, departure of male drivers and volunteers abroad, responsibility for untimely return from abroad were raised. In addition, it was discussed whether the adoption of a law that allows men to travel outside of Ukraine during martial law would change the situation. Among the important theses of the event: During martial law, sailors, athletes, cultural figures, peoples deputies, railway workers, military personnel and volunteer drivers are allowed to travel abroad without prior reservation, provided that several criteria are met. It is prohibited for male students to study abroad. Since September 14, the higher military leadership has canceled the possibility of male students crossing the Ukrainian border due to massive forgery of documents. The legislation allows the booking of employees in order to ensure the functioning of state authorities, if the person provides the necessary supporting documents when crossing the border. As of today, there are no legal restrictions on the departure of women abroad. However, military registration of women doctors remains mandatory. Currently, the requirements of the legislation do not directly establish liability for failure to return to Ukraine from abroad. However, despite this, there are categories of persons for whom violation of the terms of return to the territory of Ukraine may have negative consequences. For details on all the conditions and features of traveling abroad under martial law, see the video recording of the webinar. Finally, we see that there are many different draft laws related to the regulation of trips abroad by men of conscription age. This shows that the state fully understands the fact that there are men who are not involved in the performance of military tasks and who could work, including abroad, to strengthen the economy and increase Ukraines defense capabilities.
