Authorities strengthen market surveillance of non-food products

  In 2025, state authorities significantly intensified market surveillance and customs control over non-food products, particularly heaters (boilers) that do not comply with ecodesign requirements. A notable increase in enforcement activity occurred in the fourth quarter following an appeal from the business community calling for stricter oversight. According to the State Service of Ukraine on Food Safety and Consumer Protection, a total of 31 market surveillance measures were carried out in 2025, including 16 unplanned inspections initiated based on notifications from customs authorities. As a result, the placement on the market of approximately 1,200 non-energy-efficient heaters was prohibited, while more than 800 units of unsafe products were withdrawn from circulation and recalled from consumers. Overall, in 2025, state authorities prevented around 2,000 prohibited boilers from entering the market. According to estimates by experts from the European Business Association, this represents roughly 3% of the total circulation of banned boilers, the sales volume of which in 2025 may have reached approximately 75,000 units—exceeding half of the entire market. At the same time, the European Business Association notes a positive trend in cooperation between business and public authorities. In response to the Association’s open letter, the Ministry of Economy emphasised that market surveillance authorities have the power to withdraw or recall non-compliant products and impose sanctions on dishonest market operators. The State Agency on Energy Efficiency confirmed continued close cooperation with the State Service, customs authorities, and businesses to prevent the import and sale of products that do not meet technical regulations. Importantly, inspections of heaters have been included in the sectoral market surveillance plan for 2026, indicating a systematic approach and readiness to further strengthen control. The Association expects that in 2026, the work of public authorities in this area will not only continue but also be scaled up. Particular attention should be paid to preventing unsafe heaters from being put into operation and connected to gas distribution networks, especially in newly built multi-apartment buildings. Work on developing coordination mechanisms with the relevant authorities is already underway. The business community is confident that consistent strengthening of market surveillance and customs control will significantly reduce the presence of non-energy-efficient equipment on the market, ensure fair competition, and contribute to improving energy efficiency in Ukraine.
