Updated Regional Criticality Criteria in Odesa Region

03/ 10/ 2025
The topic of defining enterprises, institutions, and organizations as critical is extremely relevant. The clarity and transparency in applying the updated criteria affect not only the continuity of business operations but also the economic resilience of our region and the country as a whole.  On October 2, 2025, the Southern Ukrainian Office of the EBA, together with member companies, joined the “Dialogue between Authorities and Business” on “Defining Critical Enterprises, Institutions, and Organizations: Clarifications on the RSA’s Updated Criteria.” Participants included the leadership of the Odesa Regional State Administration , the Department of Economy, the Department of Life Support Systems and Energy Efficiency, and the Department of Maritime, Transport Infrastructure, and Communication.  During the meeting, businesses received clarifications on the application of the updated criteria approved in July 2025 by Resolution No. 76 of the Cabinet of Ministers of Ukraine. According to the amendments, the designation of critically important enterprises is carried out as follows:  by central executive authorities or other state bodies – for enterprises operating in sectors where these bodies develop or implement state policy;  by regional, Kyiv, and Sevastopol city state administrations (or military administrations, if established) – for municipal enterprises and private companies operating in the following sectors:  ▪ agriculture, forestry, and fisheries  ▪ mining and processing industries  ▪ electricity, gas, steam, and air conditioning supply  ▪ water supply, sewerage, waste management  ▪ construction  ▪ wholesale and retail trade, repair of vehicles  ▪ transport, warehousing, postal and courier services  What does this mean for business?  Regional administrations now have limited powers: they can only grant the status of critically important to private enterprises operating in the sectors clearly defined by the Resolution.  The European Business Association welcomes the efforts of the Odesa RSA to systematize and streamline the process of granting critical importance status. At the same time, it is essential for businesses to have a clear algorithm of actions, precise explanations, and predictability of decisions. This will allow companies to plan their activities, preserve jobs, and invest in development.  The EBA will continue to serve as a platform for constructive dialogue between business and government, since only such partnership can ensure sustainable development and strengthen Ukraine’s resilience in these challenging times.  Reference information: https://oda.od.gov.ua/ua/bronuvannya-pidpriemstv  Chat-bot: https://t.me/OODA_eko_bot  Hotline: +380 63 100 0317  Business chat: chat.whatsapp.com/FTh8Ic29Q36AfEXVCnfsfJ
