The Ministry of Digital Transformation is working on an alternative procedure for reserving meployees at companies with foreign executives

  Currently, the head of a critical enterprise must submit data on conscription-eligible employees in order to reserve them from mobilisation. However, foreign executives are unable to do so due to the requirement for access to the “Diia” portal. The Ministry of Digital Transformation is therefore developing an alternative procedure that would allow such companies to transmit reservation data to the relevant government authority that designated the company as critical. This authority would then enter the information into the Diia system on the company’s behalf. This mechanism is already in use for certain categories — such as international technical assistance projects, employees of specialised UN institutions, supervisory board members, and others. The Ministry is now working to expand this mechanism to cover enterprises that are technically unable to use the online service. This update was shared during a general meeting of the European Business Association with representatives from the Ministry of Defence of Ukraine, the Ministry of Economy of Ukraine, and the Ministry of Digital Transformation of Ukraine, held on 15 May. Other topics discussed during the meeting included the ongoing digitalisation of military registration processes, upcoming regulatory changes, and other business-relevant issues, in particular: Counting newly mobilised employees: Companies requested that those mobilised after 18 April 2024 be included in the total number of reservable employees. Testing of new functionality in the “Oberih” system is ongoing, with implementation expected in the coming weeks. Issues with cancellations of reservations in Diia: Cases were reported where an employee’s reservation status unexpectedly disappears from the “Reserv+” application. Employers may also notice cancellations when extracting data from the military register. The Ministry of Defence is working on launching push notifications in the “Reserv+” app to inform users of cancellations and provide reasons. Re-reservation period: A business proposal to shorten the re-reservation window from 72 to 24 hours was not supported by the Ministry of Economy, Ministry of Defence, or the General Staff due to potential misuse. Instead, businesses proposed allowing applications for re-reservation (i.e. extensions of current reservations) to be submitted in advance (e.g. one month before expiry). Automation of deferment for scientific and academic staff: The Ministry of Defence confirmed that work on this issue is ongoing. Stakeholders are advised to follow updates and announcements. Monitoring of critical enterprises: Ministries will gradually conduct systematic reviews of companies with critical status to ensure they continue to meet the necessary criteria. No fixed timelines for the audits were announced. Income calculation issues: It was clarified that total employee income includes sick leave payments, holiday pay, and other disbursements. Payments from previous months will be considered on a case-by-case basis. Digitalisation of company reporting: All basic conscription records are now available in the “Oberig” register and other state databases. The digitalisation of company reporting to reduce administrative burdens is being explored further. Automatic deferment for employees with three dependent children: The possibility of automatic deferment is being considered even if not all children are biological (e.g. children from a spouse’s previous marriage). Lack of accountability for delays in reviewing critical status applications: Currently, review deadlines are declarative, and no liability is in place for failing to meet them. However, authorities noted that delays are often due to incomplete or poorly prepared application packages (e.g. company reports, documentation). Issues with updating records in “Oberih” that appear in Diia: In some cases, records of dismissed employees remain in the register for months. Employees are encouraged to update their employment status manually via the “Reserv+” app. The European Business Association thanks the Ministry of Defence, the Ministry of Economy, the Ministry of Digital Transformation, and the General Staff for their openness to dialogue and comprehensive clarifications. The EBA will continue collecting relevant questions on the reservation process for further consultations with the authorities.
