Advocacy achievements of the week

  This week we have some positive news for the EBA community which relates to healthcare, import and trade in alcohol, and industrial ecology. EBA welcomes expansion of the status of the SE Medical Procurement of Ukraine as a centralized procurement organization By CMU Resolution №1093, the SE Medical Procurement of Ukraine was given the powers as a centralized procurement organization to procure drugs and medical devices for health care institutions that have concluded an agreement with the National Health Service of Ukraine on medical care under the program of medical guarantees, and structural subdivisions on health care of regional and Kyiv city state administrations. This new status is currently introduced in the framework of the pilot project until April 1, 2022. The centralized procurement organization can combine orders for medical products including drugs under the same international nonproprietary name (INN) from different customers. Another big advantage is obtaining optimal terms of purchase from suppliers and potential price reductions. Rational use of budget funds under the Medical Guarantees Program will provide an opportunity to purchase more necessary medical products for patients, as well as have a positive impact on the supply chain and planning for the manufacturers. An Action Plan to de-shadow the alcohol market will be developed Following the meeting of the EBA Wine and Spirits Committee with the Office of Business Protection of the Ministry of Internal Affairs of Ukraine, it was agreed to jointly develop an Action Plan to de-shadow the market of alcoholic beverages. Also, during the meeting, which was also attended by government officials and major producers and importers of alcohol, participants had the opportunity to discuss issues related to preventing and combating the production and sale of counterfeit alcohol. VRU Law Enforcement Committee did not support draft laws №4459 and №5204 on the criminalization of resistance of the State Environmental Inspectorate of Ukraine Thus, draft law №4459 on the criminalization of resistance and interference in the activities of the inspector of the State Environmental Inspectorate was recommended for rejection, and draft law №5204 on the criminalization of non-compliance with legal requirements of the inspector was returned to the initiator for revision. This decision was made on October 20 by members of the VRU Law Enforcement Committee. It will be recalled that draft law №4459 proposes to amend the Criminal Code of Ukraine and establish liability for resistance and interference in the activities of representatives of the State Environmental Inspectorate of Ukraine, while draft law №5204 establishes criminal liability for failure to comply with legal requirements of inspectors, namely: non-compliance with instructions and orders issued by inspectors, as well as creating obstacles to the work of inspectors. Both documents do not provide a clear understanding of what actions can be classified as resistance, influence, or obstruction of the State Environmental Inspectorate.
