The Law of Ukraine “On Postal Communications” is a mandatory step towards the EU

It was on June 23, 2022 that the European Council granted Ukraine the status of a candidate for joining the European Union. The status of a candidate requires the adaptation of Ukrainian legislation to EU legislation, which takes place through the implementation of EU Directives into the national legislation of Ukraine. One of such steps in the adaptation of national legislation was the adoption of the Law of Ukraine On Postal Communications dated November 3, 2022 No. 2722-IX (hereinafter - Law No. 2722), which will be implemented on May 23, 2023. It is worth noting that this Law was adopted for the purpose of implementing the provisions of Directive 97/67/EC Regarding the processing of personal data and protection of the right to non-interference in private life in the telecommunications sector dated December 15, 1997. Although Law No. 2722 is partially similar to the one in force now, it is aimed at more democratic principles of providing postal services, access to the market of providing postal services by operators, and significantly changes the functions of the State. One of the interesting innovations is that from 23.05.2023 the function of the State is limited exclusively to regulation, supervision and control, in contrast to the Law that is in force at the present time and according to which the State is entrusted with financing the development and reconstruction of networks and means of postal communication communication, as well as financial support of the national operator in providing universal services. It is also worth noting that Law No. 2722 established for the first time a list of universal services, as well as that these services are provided by an operator determined by the central executive body, which ensures the formation and implementation of state policy in the field of providing postal services. Time will tell whether the adoption of Law No. 2722 will improve the provision of postal services in the conditions of Ukrainian realities, but we hope that competition will do its job. However, these changes inspire hope for a better future in the commonwealth of developed countries that respect human rights and adhere to the principles of democracy.
