Interaction with law enforcement agencies in the form of requests for documents and information or execution of orders for temporary access to things and documents is one of the most frequent challenges for modern businesses. Incorrect response to such requests can lead not only to the loss of confidential data, but also to the initiation of searches and have other legal consequences. EBA Management Development Team, together with Grain Law Firm, invites you to the Online-Lecture: Request and ruling for temporary access: how businesses should respond to protect themselves. The purpose of the lecture is to analyze the legal algorithms of actions of managers, accountants and lawyers of companies in case of receiving requests, court decisions, as well as to determine the limits of the powers of investigative bodies. Target audience: business owners, security specialists and compliance managers, financial directors (CFOs), chief accountants, heads of legal departments, in-house lawyers, attorneys. How to respond to an investigator in the event of receiving a request to retrieve documents and information (in particular information that may constitute a commercial secret)? On what grounds can you refuse to issue documents and information at the investigators request? Step-by-step instructions on how to behave when you are approached with a decision of an investigating judge or court on temporary access (seizure of things, documents, information by the investigation). To which things and documents is temporary access prohibited, and which contain a secret protected by law? What to do if documents or things have already been seized? In what cases can they be returned? When do you have the right to appeal a decision on temporary access to things and documents in an appeal procedure? The price of ignoring: what does a manager really risk if he refuses to comply with a court decision?
