EBA draws the Parliament’s attention to certain environmental reforms

  As it became known, the Verkhovna Rada plans to consider a number of draft laws on environmental issues in the first plenary week which has started on January 25. The weeks agenda includes legislative initiatives aimed at the state environmental control reform (№3091 and №3091-1), the reform of permitting system in the field of industrial pollution (№4167 and №4167-1), and the subsoil use reform (№4187 and №4187 -1), etc. Therefore, EBA member companies once again emphasize the key aspects that should be taken into account when considering these draft laws: The reform of state environmental control should be based on the balance of interests of all stakeholders and a significant update of the legal framework. Apart from its controlling function, the state environmental control body should also carry out environmental monitoring and provide consulting services. In this way, it will be possible not only to identify sources of environmental damage (controlling functions) but also to prevent their occurrence (monitoring functions) following European principles. Therefore, the Association supports the return of the draft law №3091 to the Committee for its further revision before submission to the first reading. The reform of the permitting system in the field of industrial pollution should be implemented comprehensively and systematically with the consideration of the significant technological gap between Ukrainian and European companies. The business particularly emphasizes the importance of promptly submitting for public discussion a draft list of best available technologies and management methods, which will allow businesses to assess the actual time and financial needs for their implementation. The European Business Association opposes the adoption of the draft law №4167 in the first reading, as it carries significant risks for the future work of industrial enterprises of Ukraine. Instead, it supports the alternative draft law №4167-1 and asks to take it as a basis for further revision. The subsoil use reform should provide for facilitating access to the subsoil and stimulating the development of the extractive industry. There are some positive initiatives submitted to the Verkhovna Rada. However, the draft laws also contain controversial aspects that require prior broad discussion with the involvement of relevant specialists and business representatives to prevent abuse in the field of subsoil use. Therefore, EBA does not support the draft laws №4187 and №4187-1 in the current version and proposes to send them for revision for deregulation.   We hope that the voice of business will be heard and look forward to the implementation of environmental reforms in 2021!   Be the first to learn about the latest EBA news with our Telegram-channel – EBAUkraine.
