Business calls on MPs to support Draft Law №2289 to unblock farmers’ access to innovative CPPs

  The business community, united by the European Business Association, the American Chamber of Commerce in Ukraine, the Union of Ukrainian Entrepreneurs and the Ukrainian Club of Agrarian Business, calls on MPs to support draft law №2289 On Amendments to Article 4 of the Law of Ukraine On Pesticides and Agrochemicals regarding the transportation of pesticides to the customs territory of Ukraine ”and to unblock the access of farmers to innovative crop protection products. Thus, the draft law is designed to amend Article 4 of Law №86 / 95-VR On Pesticides and Agrochemicals of March 2, 1995, in terms of removing the rule that documentary evidence of the state registration in the country of production is required for the import and use in Ukraine of samples of unregistered crop protection products used for state tests and research. Such a requirement is actually impossible to fulfill. It should be noted that such a rule does not exist in the legislation of the European Union and other developed countries. The current rule appeared in early 2016 and led to the fact that Ukrainian farmers receive crop protection products 4-5 years later than their counterparts in other countries, or do not receive at all. As a result, Ukrainian farmers are deprived of innovative products that, according to business representatives, could increase crop yields and increase the greening of agriculture. Furthermore, the state suffers economic losses, because, according to the expert community, the agricultural sector provides 39% of total exports, 19% of GDP, and 40% of foreign exchange earnings, and the total losses of the crop sector are estimated at 108.3 million US dollars or UAH 2.9 billion On November 13, 2019, based on the results of the discussion of the draft law at the sitting of the Verkhovna Rada Committee on Agrarian Policy and Land Relations, it was decided to recommend to the Parliament the adoption of the draft law as a basis and as a whole. Besides, the Verkhovna Rada Committee on Anti-Corruption Policy at its meeting on February 5, 2020, concluded that the draft law meets the requirements of anti-corruption legislation. The business community is deeply convinced that the adoption of the document at the next plenary session of the Verkhovna Rada will be an important and necessary step to unlock research and state testing of innovative CPPs, which have remained blocked for several years.
