Business and the Ministry of Environment discussed drafts of the National List and the Waste Classification Procedure

  On February 28, the EBA Industrial Ecology and Sustainable Development Committee hosted a meeting with Roman Filonenko, Director of the Department of Waste Management and Environmental Safety at the Ministry of Environmental Protection and Natural Resources of Ukraine, and Tetyana Tevkun, Waste Management Reform Manager of the Reform Support Team at the Ministry. The subject of the discussion was the draft resolution of the Cabinet of Ministers of Ukraine On Approval of the Procedure for Waste Classification and the National Waste List, published on January 13, 2023, on the official website of the Ministry of Environmental Protection and Natural Resources. Thus, the participants considered the interaction between the concepts of waste and by-products. According to the new Waste Management Law No. 2320-IX, which comes into force in July 2023, substances and objects generated in the production of the main product and not the purpose of this production, but suitable as raw materials in other activities, are considered by-products, not waste. This requires a number of steps to be taken to terminate the waste status and transfer it to by-product status. This will take some time, during which the relevant substances and materials will have an indefinite status (not yet a by-product, but no longer waste). In order to prevent misinterpretation of the legislation by the company and regulatory authorities, it was agreed to provide for reference norms in the draft resolution, as well as to consider the possibility of classifying substances as by-products immediately after their generation. Moreover, the Ministry of Environmental Protection and Natural Resources plans to publish other draft regulations in the near future – the procedure for terminating the status of waste and the procedure and criteria for classifying substances as by-products. Business representatives also noted that the draft resolution gives waste generators and business entities the right to independently determine whether waste is safe or hazardous based on its properties and whether the concentration of hazardous substances in it exceeds the limits. However, no limits on the concentration of hazardous substances have been established. As explained by the Ministry of Environment, some of the concentration limits will be specified in the draft resolution. Besides, a draft technical regulation on the classification of chemicals CLP will be published soon. The Draft Procedure introduces the concept of mirror codes, when the same waste is classified in the classifier as both hazardous with a mark (*) and non-hazardous without a mark (*). The same applies to the duplication of the same types of waste in different groups and subgroups as separate types of waste. According to businesses, proving that the waste is classified correctly in practice will be difficult. Realizing the difficulties that such a novelty may cause, representatives of the Ministry of Environment have prepared draft guidelines for waste classification, as well as tables of waste compliance with the current classifier and the European one, which are planned to be published in the near future. It is important to note that the new waste classification principle is planned to be introduced on January 1, 2024, in order to preserve the current procedure for submitting statistical reports to the State Statistics Service. Under the new waste classification, companies may have questions about the cross-border transportation of waste, namely because the waste codes under the European classifier and the Basel Convention (Yellow and Green lists) differ. To address this issue, it is planned to transpose the requirements of EU Regulation 1013/2006, which implements the principles of the Basel Convention into European as well as Ukrainian legislation.
