Business supports legislative improvements to prevent violations by TCCs and MSECs

  On 27 January, the Verkhovna Rada of Ukraine registered Draft Law No. 12442, introducing amendments to the Criminal Code of Ukraine aimed at improving legislation to prevent violations by authorised representatives of Territorial Recruitment Centres (TCCs) and Military Medical Commissions (MSECs). According to European Business Association member companies, following the intensification of mobilisation processes and changes to the employee exemption and criticality status procedures (at the end of the year, many enterprises were unable to renew their criticality status due to procedural reviews and the suspension of the exemption process), a significant number of cases have been reported where: Even exempt employees of critical enterprises are being forcibly mobilised. The MSEC evaluation process is conducted in a superficial manner, denying conscripts sufficient time to gather the necessary medical documents to confirm their health status. Such actions lead to operational disruptions or even shutdowns of businesses, negatively impacting the economy and budget revenues, which are effectively the primary source of funding for the Armed Forces. Companies are forced to spend time and resources proving the necessity of retaining highly qualified specialists whose training requires substantial financial and time investments. The proposed law aims to rectify this situation by introducing liability for such actions by authorised officials. The EBA welcomes this legislative initiative. Following the increased responsibility placed on businesses regarding mobilisation processes, this law represents a logical step in the reform of mobilisation legislation, ensuring that all parties involved are held accountable. Business representatives believe that adopting this law will help to balance public administration, create transparent and fair conditions for all stakeholders, prevent corruption, and guarantee stability and predictability for businesses critical to the economy.
