  Cabinet of Ministers of Ukraine adopted the Resolution of the Cabinet of Ministers of Ukraine “On Amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 1149 from 29 October 2009” No. 810 from 29 August 2012, which imply introduction of the new version of the Technical Regulations on Low-Voltage Electrical Equipment (hereinafter – Technical Regulation). This Resolution will come into force on 10 March 2013. Background: The Technical Regulation on Safety of Low-Voltage Electrical Equipment was elaborated on the basis of EU Directive 2006/95/EU and was a great step forward to the harmonization with acquis communautaire. However the aforesaid Technical Regulation still contained significant discrepancies with the EU legislation. Thus, the EBA Consumer Electronics Committee actively advocated the idea of further improvement thereof. The EBA had a number of meetings with officials and sent a number of position papers to the state authorities particularly emphasizing the urgent necessity to harmonise this Technical Regulation with the EU-standards. In particular, the new version of the Technical Regulation harmonized definition of “low-voltage electric equipment” according to EU legislation and defined the main provisions concerning introduction of electric equipment. Moreover, the current version of TR on LV includes provisions that are not subject to the legislative regulation of Technical Regulations in terms of the determination of the powers of state market surveillance bodies. These provisions are excluded from the new edition of the Technical Regulation because such document should determine requirements to safety of low-voltage equipment, procedures of conformity assessment and procedure of their usage rather than legal and organizational frameworks for state market surveillance and control of non-food products, which are currently regulated by the Law of Ukraine On State Market Supervision and Control of Non-food Products. We would like to share this success through the prism of harmonizing Ukrainian legislation with European one and thank all EBA members who were actively involved into this initiative.
