EBA and the Ministry of Economy and Environment discussed addressing legal gaps in permitting procedures

  On 7 August, the Industrial Ecology and Sustainable Development Committee of the European Business Association held a working meeting between business representatives and Oleksandr Krasnolutskyi, Deputy Minister of Economy and Environment of Ukraine, and representatives of the Ministry. The participants discussed ways to address legal gaps in permitting procedures and the application of legislation on administrative procedure. Business representatives highlighted issues arising for companies from the application of the relevant legislation, including risks associated with the suspension of permitting procedures. Particular emphasis was placed on the need to ensure predictability in permitting procedures and a consistent approach to their implementation. The participants also discussed the need to align the provisions of legislation on administrative procedure with sector-specific permitting legislation, as well as the practical challenges faced by businesses. Following the meeting, the participants developed a further action plan to address the issues raised and seek systemic solutions to eliminate legal gaps and ensure the proper functioning of permitting procedures. We thank the Ministry of Economy and Environment of Ukraine for the open and constructive dialogue, its willingness to consider the business community’s position, and its readiness to work together to improve the permitting system and create more predictable conditions for doing business.
