EBA does not oppose measures to support domestic manufacturers The European Business Association does not oppose localisation as a public policy or the states right to support domestic manufacturers and ensure compliance with localisation legislation. The Associations appeal to Members of Parliament does not propose abolishing localisation requirements or discontinuing compliance checks. Instead, it calls for improving the legislative framework to ensure that oversight is effective, transparent, applied consistently to all market participants, and does not allow for arbitrary enforcement. This is precisely the position outlined in the Associations letter, which is available here. Even well-intentioned policy objectives should be pursued through transparent, predictable, and proportionate instruments. This is one of the fundamental principles of the European approach to regulation. Oversight Should Be Clear and Risk-Based Responsible manufacturers and suppliers do not object to verifying compliance with localisation requirements. On the contrary, effective oversight is essential for identifying and removing bad-faith market participants. At the same time, any supervisory powers must be exercised in accordance with the rule of law, with clearly defined legal grounds, procedures, timelines, and safeguards protecting the rights of businesses. Furthermore, effective state oversight should be based on a risk-based approach. Responsible Businesses Support Effective Oversight Responsible manufacturers and suppliers are the first to be interested in removing companies that unlawfully present imported products as locally manufactured. Such practices distort competition and undermine the credibility of the localisation mechanism itself. For this reason, the business community supports effective oversight, provided it is exercised on the basis of a clear and predictable legislative framework. Today, the European Business Association brings together 925 member companies. Its membership includes hundreds of businesses that manufacture in and invest in Ukraine, create jobs, and pay taxes responsibly. Notably, 43% of EBA members are Ukrainian companies. The Associations objective has always been to promote a balanced approach and protect a level playing field for all responsible businesses. We call on all stakeholders to engage in a professional and constructive dialogue on how to strengthen genuine and economically sound localisation, eliminate opportunities for abuse, and, at the same time, avoid creating new corruption risks or unnecessary regulatory burdens.
