New Mechanism for Termination of Employment in Electronic Form

  On 1 April 2026, the Cabinet of Ministers of Ukraine approved Resolution No. 410, dated 1 April 2026, “On the Implementation of the Experimental Project for Termination of Employment at the Employee’s Initiative with an Employer Located in the Territory of Active Hostilities or a Territory Temporarily Occupied by the Russian Federation” (the “Resolution”), which introduces the possibility for employees to terminate employment at their own initiative by electronic means. Key provisions Employees whose employers are located in territories of active hostilities or in territories temporarily occupied by the russian federation may submit a resignation application electronically via the Unified Information and Analytical System “Obrii,” using the Ukrainian Government’s Web Portal of Electronic Services, including through the Diia Portal mobile application.   This mechanism does not apply to the termination of employment with chief executive officers of companies, institutions, or organizations, nor to persons holding elected positions.   The date of termination of employment shall be the day following the registration of the resignation application in the Unified Information and Analytical System “Obrii”. The consent of the employer or the issuance by the employer of a termination order is not required to complete the termination.   The employer is required to pay all amounts due to the employee and to return the employee’s labor book on the next business day following the employee’s written request, upon cessation of active hostilities, the de‑occupation of the relevant territory, or the employer’s re‑registration in another region of Ukraine. Additional information Please note that the Resolution will enter into force on 7 July 2026, i.e., three months following the date of its official publication. Although the termination mechanism via the Diia Portal will initially have a relatively limited scope of application, it establishes an important precedent and may pave the way for further legislative amendments aimed at simplifying the termination procedure.
