Business and Government have discussed new rules for importing goods that contain fluorinated greenhouse gases

  On January 20, there was a working meeting of EBA member companies and representatives of government agencies, namely, the Ministry for Development of Economy, Trade and Agriculture of Ukraine, the Ministry of Environment and Natural Resources of Ukraine, and the State Customs Service of Ukraine to discuss the import of goods containing fluorinated greenhouse gases which is regulated by the CMU Resolution №1329 and Annex 2 of Law 376-IX on the regulation of economic activities with ozone-depleting substances and fluorinated greenhouse gases. During the meeting, customs officials noted that if such goods as air conditioners, refrigerators, cosmetics, medicines, paints, or varnishes, etc. (more in Annex 3 to the CMU Resolution №1329) contain no fluorinated greenhouse gases, set out in Annex 2 of the same Resolution, then it is necessary to specify this respective information in the customs declaration and to import those goods without the license. At the same time, if any of the above goods contain fluorinated greenhouse gases, the importers must obtain a license from the Mineconomy. It should be noted that the issuance of the license is free of charge. It is possible to apply for a license online through the Unified State Portal of Administrative Services or by sending a regular mail to the Ministry. To issue this document, the Mineconomy must also obtain the approval of such a license from the Ministry of Environmental Protection according to the law. We draw the attention of businesses that the same product may or may not contain fluorinated greenhouse gases - so each manufacturer must check the gas formula in the regulation, define whether the product contains fluorinated greenhouse gases and whether it is necessary to obtain a license. Representatives of both Ministries said they would try to issue the appropriate licenses and approvals as soon as possible so as not to delay the customs clearance process. However, the current situation is complicated by the impossibility to issue the above-mentioned approvals before the adoption of amendments to Order №459 of the Ministry of Environmental Protection, which establish the form of such approvals. A draft of such an order has already been developed, therefore the business hopes for its prompt adoption. The European Business Association is grateful to government officials for their openness to dialogue and constructive discussion.
