The Resolution amends the rules for obtaining protecting employees from mobilization. It also establishes the Coordination Center for Organizing Reservation of Persons Liable for Military Service during Mobilization and Wartime (“CoordinationCenter“) and approves the regulations governing the Coordination Center’s operation and composition.

In details

1. The Coordination Center has been established as a temporary consultative and advisory body of the Cabinet of Ministers of Ukraine. Nevertheless, it has been granted significant powers, including:

approving industry-specific criteria for obtaining recognition as a critically important business;

reviewing company applications for recognition as a critically important business and applications to increase the quota of employees protected from mobilization;

issuing recommendations to revoke a company’s critically important status;

monitoring data on employees liable for military service at companies that have applied for critically important business status.

2. Obtaining recognition as a critically important business will now take longer and may formally take up to one and a half months. The procedure now includes the following main stages:

up to 7 business days from receipt of the company’s application: the relevant ministry or local military administration reviews the application and refers it to the Coordination Center;

up to one calendar month: the Coordination Center reviews the application. This period may be reduced to 7 business days if there are grounds for urgent review.

up to 3 business days from receipt of the Coordination Center’s recommendations: the relevant ministry or local military administration either designates the company as critically important or notifies it of a reasoned refusal.

3. Within 10 days after the Resolution takes effect, ministries and local military administrations must review their criteria for recognition as a critically important business and obtain the Coordination Center’s approval of those criteria. If an existing criterion for recognition as a critically important business is cancelled, all decisions granting that status to companies based on that criterion will be revoked.

All other existing decisions granting critically important business status will remain valid until they expire.

4. Companies may still request the relevant ministry or local military administration increase the quota of employees who may be reserved above 50%, but the Coordination Center’s position will now be taken into account.

5. In particular, the Coordination Center may refuse to approve an increase in the quota if the head of the company has systematically breached the military registration rules. This includes two or more documented breaches within the previous 12 months and/or the imposition of an administrative fine on the head of the company for such breaches.

6. Decisions of the Ministry of Defense of Ukraine to increase the quota of reserved employees will remain valid as follows:

decisions adopted before 8 December 2025: remain valid for their specified term, but no later than 8 December 2026;

decisions adopted after 8 December 2025: remain valid for the term specified in the relevant decision.

Additional information

The Resolution makes the procedure for reserving employees more complex and time-consuming. We therefore recommend that employers take the following steps:

Check the criteria under which a critically important business status was granted. Monitor whether the relevant criterion is removed.

Check the validity period of any decision increasing the quota of reserved employees. Pay particular attention to the 8 December 2026 cut-off date.

Audit compliance with military registration rules. Breaches prevent the company from reserving its employees.

Submit applications for critically important business status well in advance. Allow for the new timeframes, under which the formal process may now take up to one and a half months.

Contacts

Lina Nemchenko

Partner Baker McKenzie

Mariana Marchuk

Counsel Baker McKenzie

Stanislav Muzhailo

Associate Baker McKenzie

The Government has amended the rules for protecting employees from mobilization to the Army.
