The European Business Association supports Draft Law No. 15454<\/a>, aimed at improving the mechanisms for granting and exercising subsoil use rights through auctions, and advocates for its adoption at first reading.<\/p>\n

The business community believes that the consistent improvement of legislation in the field of subsoil use, greater transparency of procedures and predictable operating conditions will help attract investment to the extractive sector, develop Ukraine\u2019s resource potential and strengthen its economic resilience.<\/p>\n

Changes positively assessed by business:<\/p>\n

    \n
  1. Improving the auction procedure. Setting out the key requirements for electronic auctions directly in the Subsoil Code of Ukraine should make the procedures more transparent and predictable for potential subsoil users.<\/li>\n
  2. Expanding the scope of legislative stability guarantees. Extending such guarantees to oil and gas-bearing subsoil areas is important given the significant capital investment and lengthy project timelines in the extractive sector. The stability of the legislative framework is an important factor when making investment decisions.<\/li>\n
  3. Clarifying the rules for production sharing agreement tenders. Clearer rules for tender procedures and greater transparency may help strengthen investor confidence and attract private capital.<\/li>\n
  4. Addressing certain land-related issues. The possibility of carrying out exploration works by agreement with the landowner or land user may simplify the implementation of investment projects and access to the land required for their development.<\/li>\n<\/ol>\n

    At the same time, the Association\u2019s Subsoil Use Committee considers it important to continue working, during the preparation of the draft law for the second reading, on issues that directly affect the practical exercise of subsoil users\u2019 rights.<\/p>\n

    In particular, further consideration is needed of state control mechanisms, the conclusion and implementation of production sharing agreements, as well as interaction between subsoil users and landowners and land users.<\/p>\n
