Attorneys Association Gestors<\/a> team argued that the prosecutor lacked proper legal grounds to represent the interests of the State Service of Special Communications and Information Protection of Ukraine, as the Service is a separate legal entity capable of independently protecting its rights.<\/p>\nIn considering the case, the Supreme Court relied on the Constitutional Court of Ukraine\u2019s legal positions concerning the constitutional powers of the prosecution authorities, including those set out in its 2019, 2020 and 2025 decisions.<\/p>\n
The Supreme Court ultimately upheld Gestors\u2019 legal position and left in force the appellate court\u2019s decision returning the prosecutor\u2019s claim without consideration.<\/p>\n
