Scope of the Procedure<\/strong><\/h4>\n<ul>\n<li><u>Eligible goods:<\/u><\/li>\n<\/ul>\n<p>&#8211; military items accepted for armament or codified as items of supply;<\/p>\n<p>&#8211; dual-use items used for the development, production or use of such military items; and<\/p>\n<p>&#8211; military and dual-use technologies.<\/p>\n<ul>\n<li><u>List of Critical Goods<\/u> \u2013 to be approved periodically. Inclusion in the list constitutes grounds for refusing an export permit.<\/li>\n<li><u>Value threshold<\/u> \u2013 exports valued at UAH 15 million or more. The threshold does not apply to components and spare parts.<\/li>\n<li><u>Eligible destinations<\/u> \u2013 countries that have concluded a \u201cDrone Deal\u201d with Ukraine or are included in a periodically approved list of eligible countries.<\/li>\n<li><u>Foreign parties<\/u> \u2013 importers, end-users and intermediaries must satisfy applicable criteria related to sanctions, ownership, and ultimate control.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong><em>Practical uncertainty<\/em><\/strong><em><strong>:<\/strong> application of the standard export control framework to transactions falling outside the scope of the Procedure.<\/em><\/p>\n<h4><strong>2. Export Approval Process<\/strong><\/h4>\n<p style=\"font-weight: 400;\">The Procedure establishes a special process for obtaining export permits.<\/p>\n<p style=\"font-weight: 400;\"><strong><em>NB: <\/em><\/strong><em>The applicant must be registered with the State Service of Export Control of Ukraine (the \u201c<strong>SSECU<\/strong>\u201d) as an entity engaged in international transfers.<\/em><\/p>\n<ul>\n<li><strong><u>Application package<\/u><\/strong> \u2013 must include, inter alia, importing-state guarantees regarding technology transfers and evidence of the value of the goods (state defence procurement contract or expert opinion).<\/li>\n<li><u>Authorities involved in the review<\/u> \u2013 the SSECU, Ministry of Defence, Security Service of Ukraine, Foreign Intelligence Service and Defence Intelligence. The Interagency Commission is additionally involved in certain higher-risk cases.<\/li>\n<li><u>Review period<\/u> \u2013 30 calendar days.<\/li>\n<li><strong><u>Grounds for refusal<\/u><\/strong> \u2013 include, inter alia, the planned procurement of the respective goods for Ukraine\u2019s own defence needs and a failure to perform state defence contracts.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong><em>Practical uncertainty:<\/em><\/strong><em> certain application requirements (e.g., whether importing-state guarantees are required for the export of finished products).<\/em><\/p>\n<h4><strong>3. Special Rules for Technology Transfers<\/strong><\/h4>\n<ul>\n<li><u>Form of transfer<\/u> \u2013 generally limited to a right of use, without assignment of the IP rights.<\/li>\n<li><u>Production limits<\/u> \u2013 products may be manufactured only in the agreed-upon quantities and on the agreed terms.<\/li>\n<li><u>Improvements<\/u> \u2013 information on improvements to products manufactured using the transferred technology must be provided to Ukraine.<\/li>\n<li><u>Further transfers <\/u>\u2013 re-export, sale and other subsequent transfers of technology and manufactured products require prior SSECU approval<\/li>\n<li><u>Third-country transfers <\/u>\u2013 subject to an additional fee of 20% of the value of the relevant products<u>.<\/u><\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><em><strong>Practical uncertainty:<\/strong> the procedure for obtaining SSECU approval for subsequent transfers of technology and products manufactured using the given technology.<\/em><\/p>\n<h4><strong>4. Export Permit Fee<\/strong><\/h4>\n<ul>\n<li><u>Finished products<\/u> \u2013 20% of the respective value.<\/li>\n<li><u>Components and spare parts<\/u> \u2013 30% of the respective value.<\/li>\n<li><u>Technology<\/u> \u2013 20% of the value of those goods that may be manufactured under the relevant technology license.<\/li>\n<li><u>Third-country transfers<\/u> \u2013 an additional 20% of the value of those goods manufactured using the transferred technologies.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong><em>Practical uncertainty:<\/em><\/strong><em> detailed calculation rules are provided only for technology exports.<\/em><\/p>\n<h4><strong>5. Government Authorization Exemption<\/strong><\/h4>\n<p style=\"font-weight: 400;\">In addition to introducing the Procedure, the Resolution expands the exemptions from the requirement for Cabinet of Ministers authorization for the export of military goods.<\/p>\n<ul style=\"font-weight: 400;\">\n<li><u>Eligible exporters<\/u> \u2013 manufacturers of the relevant military items and holders of rights to the relevant technologies.<\/li>\n<li><u>Additional requirement<\/u> \u2013 the exporter must perform state defence contracts and\/or be included in the Register of Defence Suppliers.<\/li>\n<\/ul>\n<h4><strong>6.
