The European Business Association has addressed the Ministry of Economy, Environment and Agriculture of Ukraine and the State Organisation \u201cPublic-Private Partnership Agency\u201d (PPP Agency) requesting information and copies of commercial partnership agreements concluded within the framework of the US\u2013Ukraine Reconstruction Investment Fund.<\/strong><\/p>\n It is recalled that on 30 April 2025, Ukraine and the United States signed an Agreement on the establishment of the US\u2013Ukraine Reconstruction Investment Fund<\/strong>, which was subsequently ratified by the Verkhovna Rada of Ukraine. It was later announced that the US International Development Finance Corporation (DFC) and the PPP Agency had signed two agreements \u2014 a Limited Partnership Agreement<\/strong> and a Limited Liability Company Agreement<\/strong>.<\/p>\n The partnership is intended to stimulate investment in critical sectors of Ukraine\u2019s economy to support its recovery. At the same time, provisions of the Limited Partnership Agreement envisage the introduction of certain conditions in the issuance of subsoil use licences<\/strong>, including requirements related to agreements on the purchase of extracted resources.<\/p>\n The business community emphasises that such provisions may directly affect the activities of subsoil users, the competitive environment, and the investment attractiveness of the extractive sector.<\/p>\n At the same time, the PPP Agency classified documents related to the agreements as restricted information for official use. The Association notes that the Law of Ukraine \u201cOn Access to Public Information\u201d provides for disclosure of the public part of information even where certain data is restricted, and that classification as \u201cfor official use only\u201d is only permissible under specific legal grounds.<\/p>\n Business considers the content of these agreements to be of public interest, as they define the conditions for economic activity and the investment outlook of Ukraine\u2019s extractive sector, and calls for the disclosure of this information.
