Following this, the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">State Service of Geology and Subsoil Resources\u00a0of Ukraine<\/span><\/span> launched an audit of \u201cdormant\u201d and problematic special subsoil use permits. In particular, unscheduled inspections were initiated for 38 valid permits issued for the exploration and development of strategic and critical minerals, as well as oil and gas-bearing subsoil.<\/p>\n<p data-start=\"581\" data-end=\"850\">Member companies of the Subsoil Use Committee of the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">European Business Association<\/span><\/span> support the need to enhance the effectiveness of state control in the sector. At the same time, they draw attention to a number of issues that have arisen during the inspections.<\/p>\n<p data-start=\"852\" data-end=\"1122\">In particular, based on inspection results, state geological control authorities have been recording in their reports alleged non-fulfilment of works stipulated\u00a0in the Work Programmes \u2014 annexes to subsoil use agreements, which form an integral part of special permits.<\/p>\n<p data-start=\"1124\" data-end=\"1235\">At the same time, the <a href=\"https:\/\/eur03.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fzakon.rada.gov.ua%2Flaws%2Fshow%2F132%2F94-%25D0%25B2%25D1%2580%23Text&amp;data=05%7C02%7CValeriia.Diachok%40eba.com.ua%7C4e63c7a21d1d45041f9508de96d64ce8%7C92456a16661b498eadd5e224c7dd6afa%7C0%7C0%7C639114044335575165%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=D%2F6s0t1rblDNIVXCuaYxuxz2vHJoGYQOjfk3PzzWH20%3D&amp;reserved=0\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Subsoil Code of Ukraine<\/span><\/span><\/a> explicitly provides for the automatic extension of:<\/p>\n<ul data-start=\"1236\" data-end=\"1544\">\n<li data-section-id=\"cdouvw\" data-start=\"1236\" data-end=\"1384\">the validity periods of special permits that were in force at the time martial law was introduced, or those that expired during its application;<\/li>\n<li data-section-id=\"isef1x\" data-start=\"1385\" data-end=\"1544\">the deadlines for the completion of works defined in subsoil use agreements \u2014 for the duration of martial law and for three months following its termination.<\/li>\n<\/ul>\n<p data-start=\"1546\" data-end=\"1752\">According to the Association\u2019s experts, this provision means there are no legal grounds to consider the deadlines for completing works as having been violated, since they are subject to automatic extension.<\/p>\n<p data-start=\"1754\" data-end=\"2036\">Subsoil users emphasise the need for clear and consistent application of legislation during the audit of strategic minerals. Formalistic or ambiguous interpretation of legal provisions may lead to companies being labelled as \u201cnon-compliant\u201d, creating significant risks for business.<\/p>\n<p data-start=\"2038\" data-end=\"2433\">Such a status negatively affects companies\u2019 business reputation, complicates cooperation with financial institutions and partners, and effectively blocks the attraction of international investment. At a time when the development of the strategic and critical minerals sector requires substantial capital inflows, such regulatory approaches may undermine the industry\u2019s investment attractiveness.<\/p>\n<p data-start=\"2435\" data-end=\"2780\">The Association\u2019s experts also note that the automatic extension of deadlines was introduced precisely in view of the real challenges of martial law \u2014 including security risks, constant shelling, labour shortages, and logistical constraints.
