Member companies of the Subsoil Use Committee of the European Business Association have appealed to Members of Parliament of Ukraine to support the adoption in the first reading of Draft Law No. 14249 \u201cOn Amendments to the Subsoil Code of Ukraine Regarding the Improvement of Legal Regulation of Subsoil Use and the Provision of Guarantees for Investors.\u201d<\/a><\/p>\n

According to the business community, the provisions of the draft law are aimed at improving the legal regulation of the subsoil use sector, attracting potential subsoil users, and increasing the investment attractiveness of the industry. In addition, the document is intended to address a number of problematic issues that have remained unresolved for a long time.<\/p>\n

Experts of the Association highlight several important provisions of the draft law. In particular, it proposes to regulate the procedure for conducting electronic auctions for the sale of special permits for subsoil use in cases where only one participant takes part<\/strong>. This would allow the initiator of the auction to obtain the special permit if no other bidders participate.<\/p>\n

The draft law also provides for improvements to the mechanism for the automatic extension of special permits for subsoil use<\/strong>, which will help ensure the uninterrupted operation of companies in the extractive industry both during martial law and after it ends. At the same time, establishing a clear procedure for the actions of the permitting authority in this process will help avoid ambiguous interpretations of the legislation by government bodies.<\/p>\n

Among other important provisions is the introduction of legislative stability guarantees regarding the use of subsoil plots of strategic and critical importance<\/strong>. According to experts, this will have a positive impact on the investment climate in the sector and contribute to attracting investors and partners.<\/p>\n

In addition, the document improves the regulation of transitional arrangements for obtaining special permits for subsoil use by holders of certain types of permits<\/strong>. This will help ensure clearer legal regulation of the transition to the next stage of subsoil use \u2014 the extraction of mineral resources.<\/p>\n

Member companies of the Association also emphasise that, in the context of the armed aggression of the Russian Federation, gas production facilities and related infrastructure are regularly subjected to massive attacks. Under such circumstances, addressing problematic issues in the field of subsoil use and ensuring stable and predictable conditions for companies operating in the sector becomes particularly important for strengthening the country\u2019s energy resilience.<\/p>\n
