The proposal of the Consumer Electronics\u00a0Committee of the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">European Business Association<\/span><\/span> concerning the timeline for the entry into force of the Technical Regulation was taken into account.<\/p>\n<p data-start=\"577\" data-end=\"1003\">The draft Resolution, published for public consultation, had envisaged that most provisions of the Technical Regulation would enter into force six months after the termination or lifting of martial law. While members of the Committee supported the need to harmonise Ukrainian legislation with European ecodesign requirements, they drew attention to the risks associated with such an approach to determining the effective date.<\/p>\n<p data-start=\"1005\" data-end=\"1527\">In particular, the business community emphasised that: (1) manufacturers are unable to predict the date of termination of martial law and, consequently, to plan production accordingly; (2) the European Union already applies an updated Regulation on which the Ukrainian draft was based, whereas the previous regulatory framework continued to apply in Ukraine; (3) manufacturers are required to adapt products separately for the Ukrainian market, despite Ukraine being considered part of the broader European market.<\/p>\n<p data-start=\"1529\" data-end=\"1741\">From an economic perspective, unified production for both the EU and Ukraine is more efficient, as it reduces costs, optimises logistics, expands product range and helps contain price increases for end consumers.<\/p>\n<p data-start=\"1743\" data-end=\"2080\">Accordingly, the Association submitted an official letter to the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">State Agency on Energy Efficiency and Energy Saving of Ukraine<\/span><\/span>, proposing to remove the linkage between the entry into force of the Technical Regulation and the termination of martial law, and instead provide for its entry into force within a defined period following its official publication.<\/p>\n<p data-start=\"2082\" data-end=\"2277\">On 5 February 2026, the Government adopted <a href=\"https:\/\/ebaua-my.sharepoint.com\/personal\/viktoriia_kulykova_eba_com_ua\/Documents\/%D0%A0%D0%BE%D0%B1%D0%BE%D1%87%D0%B8%D0%B9%20%D1%81%D1%82%D1%96%D0%BB\/energy%20TR\/EcoDes\/2026\/TR%20ecodes%20servers\/%D1%89%D0%BE%D0%B4%D0%BE%20%D0%B2%D0%B8%D0%BC%D0%BE%D0%B3%20%D0%B4%D0%BE%20%D0%B5%D0%BA%D0%BE%D0%B4%D0%B8%D0%B7%D0%B0%D0%B9%D0%BD%D1%83%20%D0%B4%D0%BB%D1%8F%20%D1%81%D0%B5%D1%80%D0%B2%D0%B5%D1%80%D1%96%D0%B2%20%D1%82%D0%B0%20%D0%BF%D1%80%D0%BE%D0%B4%D1%83%D0%BA%D1%86%D1%96%D1%97%20%D0%B4%D0%BB%D1%8F%20%D0%B7%D0%B1%D0%B5%D1%80%D1%96%D0%B3%D0%B0%D0%BD%D0%BD%D1%8F%20%D0%B4%D0%B0%D0%BD%D0%B8%D1%85?xsdata=MDV8MDJ8VmFsZXJpaWEuRGlhY2hva0BlYmEuY29tLnVhfGY5MTM0M2Y3MDg1OTRjODJmZDc2MDhkZTZlYzIzZTFjfDkyNDU2YTE2NjYxYjQ5OGVhZGQ1ZTIyNGM3ZGQ2YWZhfDB8MHw2MzkwNjk5Nzc3MDI3OTcyNDF8VW5rbm93bnxUV0ZwYkdac2IzZDhleUpGYlhCMGVVMWhjR2tpT25SeWRXVXNJbFlpT2lJd0xqQXVNREF3TUNJc0lsQWlPaUpYYVc0ek1pSXNJa0ZPSWpvaVRXRnBiQ0lzSWxkVUlqb3lmUT09fDB8fHw%3d&amp;sdata=T1gxdFk2b3VSLzdRWVFEa2VJUnRRTWNINWpTbjNwa3lmWGE2S3RqRSsrQT0%3d\">Resolution No. 160<\/a>, stipulating that the Technical Regulation will enter into force six months after its official publication, namely on 11 August 2026.<\/p>\n<p data-start=\"2279\" data-end=\"2598\">The Association welcomes this decision, as it ensures regulatory predictability, enables manufacturers and importers to plan production processes in advance, facilitates the harmonisation of Ukrainian regulation with EU standards, and supports competitiveness and the expansion of product range on the Ukrainian market.<\/p>\n<p data-start=\"2600\" data-end=\"2865\" data-is-last-node=\"\" data-is-only-node=\"\">The European Business Association expresses its gratitude to the Cabinet of Ministers of Ukraine and the State Agency on Energy Efficiency and Energy Saving of Ukraine for the constructive dialogue and for taking into account the position of the business community.<\/p>\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>On 5 February 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 160 \u201cOn Approval of the Technical Regulation on Ecodesign Requirements for Servers and Data Storage Products\u201d.
