With the entry into force of the Law of Ukraine \u201cOn Waste Management\u201d No. 2320-IX<\/a>, new requirements were introduced to the permitting system in the field of waste management, including the obligation to obtain a permit for carrying out waste treatment operations.<\/p>\n

Until the adoption of a separate specialised law, the management of waste from the extractive industry is regulated in accordance with the provisions of this Law. Transitional deadlines were established for operating enterprises to obtain the relevant permits, which expired in the first half of 2024.<\/p>\n

At the same time, in 2024, extractive industry waste was excluded from the scope of the Procedure for Issuing Permits, and in December 2025 it was reinstated. However, no additional transitional period for obtaining permits was provided for by the legislation.<\/p>\n

According to experts of the Industrial Ecology and Sustainable Development Committee of the European Business Association, this situation may create legal uncertainty and risks for businesses. For example, companies may face liability for the absence of permit documentation, the issuance of which requires significant time, including the completion of an environmental impact assessment procedure.<\/p>\n

In this regard, the Association\u2019s Committee has addressed the Ministry of Economy, Environment and Agriculture of Ukraine, the State Regulatory Service of Ukraine, and the Verkhovna Rada Committee on Environmental Policy and Nature Management with proposals to resolve the issue of permits.<\/p>\n

The business community proposes to consider either:<\/p>\n
