This prevents price manipulation that could be used for tax evasion or profit shifting to jurisdictions with low tax rates.<\/p>\n<p style=\"font-weight: 400;\">In December 2024, the Cabinet of Ministers of Ukraine adopted <a href=\"https:\/\/www.kmu.gov.ua\/npas\/pro-vnesennia-zmin-u-dodatok-do-postanovy-kabinetu-ministriv-ukrainy-vid-27-hrudnia-2017-r-1045-i271224-1505\">Resolution No. 1505 <\/a>on significant issues that <a href=\"https:\/\/mof.gov.ua\/uk\/news\/the_government_has_updated_the_list_of_states_territories_for_transfer_pricing_purposes-4970\">directly impact international transactions and tax policy of companies<\/a>. The primary changes include an updated list of low-tax jurisdictions, which is essential for effective planning of transactions with residents in such jurisdictions.<\/p>\n<p style=\"font-weight: 400;\">In accordance with the provisions of <a href=\"https:\/\/eur02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fzakon.rada.gov.ua%2Flaws%2Fshow%2F3813-IX%23Text&amp;data=05%7C02%7Castupenko%40bdo.ua%7Cc0f7d6834a6c4601ed8a08dd4c3d18c0%7Cb3f676b6ec0b4860822372923838edcb%7C1%7C0%7C638750549809300625%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=c2FCb%2B2Db0nLdsWB4fzl3TcLfUzAP%2FnSjMbVBZgKqGQ%3D&amp;reserved=0\">Law No. 3813-IX <\/a>\u201cOn Amendments to the Tax Code of Ukraine on Peculiarities of Tax Administration during Martial Law for Taxpayers with a High Level of Voluntary Compliance with Tax Law\u201d, as a result of <a href=\"https:\/\/www.kmu.gov.ua\/storage\/app\/uploads\/public\/677\/26d\/a40\/67726da40d822235786921.pdf\">the list reformed <\/a>, the number of jurisdictions was reduced from 78 to 46, most of which are classic offshore and low-tax jurisdictions.<\/p>\n<p style=\"font-weight: 400;\">Removed from the list<\/p>\n<ul>\n<li>Among others, Cyprus, Ireland, Moldova, Hong Kong<\/li>\n<li>countries with which Ukraine has concluded international treaties for the avoidance of double taxation.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\">New states are included:<\/p>\n<ul>\n<li>countries included in the list of offshore zones, as approved by the Cabinet of Ministers of Ukraine on February 23, 2011 No. 143-p<\/li>\n<li>countries blacklisted by FATF (Financial Action Task Force)<\/li>\n<li>states (territories) that do not ensure timely and complete exchange of tax and financial information.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\">However, the effective date of the updated list remains uncertain: either from the beginning of 2025, or from 2026 (since according to sub-clause 39.2.1.2 of the Tax Code of Ukraine <a href=\"https:\/\/zakon-pro.ligazakon.net\/document\/T243813?ed=2024_06_18&amp;an=43\">\u201c<em>In case of approval of changes to the said list after November 30, such changes shall apply from January 1 of the second reporting year following the calendar year in which such changes were made<\/em>.<\/a>\u201d).
