It provides organizational and technical support services of the mediation procedure and facilitates the organization of mediation processes in resolving IP disputes. Thus, the UANIPIO creates a platform for mediation where parties and mediators are the participants of the process. The Center provides access to the <strong>Register of Mediators<\/strong>, so that the parties can choose who to involve in the case. The mediators not only possess negotiation skills to resolve disputes, but also have <strong>thorough expertise in IP law<\/strong>, which helps to resolve the issue taking into account all the specifics of a particular industry. The Center <strong>provides an additional tool<\/strong> for IP rights holders to <strong>resolve disputes without litigation<\/strong>.<\/p>\n<p><strong>Key points<\/p>\n<p>What is the difference between mediation and litigation?<\/strong><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-573307 size-full\" src=\"https:\/\/eba.com.ua\/wp-content\/uploads\/2024\/07\/Picture1.jpg\" alt=\"\" width=\"647\" height=\"502\" srcset=\"https:\/\/eba.com.ua\/wp-content\/uploads\/2024\/07\/Picture1.jpg 647w, https:\/\/eba.com.ua\/wp-content\/uploads\/2024\/07\/Picture1-300x233.jpg 300w, https:\/\/eba.com.ua\/wp-content\/uploads\/2024\/07\/Picture1-373x290.jpg 373w\" sizes=\"(max-width: 647px) 100vw, 647px\" \/><\/p>\n<p><strong>Mediation within the Center may be initiated at the following stages:<\/strong><\/p>\n<ul>\n<li>Before applying to court, arbitral tribunal or international commercial arbitration<\/li>\n<li>During the pretrial investigation, court, arbitral or arbitration proceedings<\/li>\n<li>During the enforcement of a court decision, arbitral tribunal decision or international commercial arbitration award<\/li>\n<\/ul>\n<p><strong>When will you benefit from mediation?<\/strong><\/p>\n<p>Parties will benefit from mediation in the following circumstances:<\/p>\n<ul>\n<li>Parties are from different countries.<\/li>\n<li>There are multiple conflicts between the same parties.<\/li>\n<li>Dispute involves several IP rights (e.g., EU-registered trademarks, nationally registered trademarks, registered or unregistered industrial designs, copyrights, patents).<\/li>\n<li>Parties that were not involved in the original dispute must join the action.<\/li>\n<li>There are obstacles to the enforcement of a court decision.<\/li>\n<li>Confidentiality of the request, materials, discussions and results is important.<\/li>\n<li>There is a need to use a single language during the process if the dispute involves representatives of different jurisdictions.
