The main goal of sanctions is to deprive russia of the ability and resources to wage war against Ukraine. If such a situation occurs, a company can appeal to the relevant authority that imposed the restrictions to have the sanctions lifted. The state is interested in ensuring that Ukrainian businesses continue to operate but russian owners are denied access to these resources.<\/p>\n

This view was expressed by the participants of the dialogue “Synergy of Business and the State in Sanction Policy”<\/strong>,<\/strong> organized by the European Business Association on May 31 to discuss the details of the implementation and execution of sanctions in Ukraine, as well as the potential cooperation between businesses and the government regarding sanctions\u2019 pressure.<\/p>\n

According to the National Security and Defense Council, there are currently 14,373 entities under Ukrainian sanctions, including 5,566 legal entities and 8,807 individuals. These measures were implemented through 99 decrees issued by the President of Ukraine, with approximately one-third of these decrees issued since the beginning of the full-scale invasion.<\/p>\n

Russia is subject to both Ukrainian and international sanctions. In particular, the International Working Group on russian Sanctions under Stanford University has prepared several plans for international sanctions. The first plan is general, the second focuses on the oil and gas industry, and the third involves personal sanctions against companies and individuals. Sanctions are a relatively new political and legal instrument for Ukraine, as the sanction policy was only established in 2014 with the adoption of the Law of Ukraine “On Sanctions,” which regulates the procedure for their implementation.<\/p>\n

The role of government bodies in the sanction process<\/strong><\/p>\n

Sanctions can be imposed, modified, or lifted by a decision of the National Security and Defense Council (NSDC), which is implemented through a decree by the President. The President of Ukraine, the Verkhovna Rada (Parliament), the Cabinet of Ministers, the Security Service of Ukraine, and the National Bank of Ukraine can initiate proposals for the imposition of sanctions to be considered by the NSDC.<\/p>\n

Since the start of the full-scale invasion, at the initiative of the National Agency for Corruption Prevention (NACP), the possibility of confiscating the assets of sanctioned individuals was initiated. This measure was adopted in April and became effective in June. After the imposition of sanctions, the Ministry of Justice of Ukraine conducts a series of activities in collaboration with various law enforcement and anti-corruption agencies to gather evidence and grounds for enforcement. Subsequently, the Ministry files a lawsuit with the High Anti-Corruption Court. The recently adopted Law on the Reform of the State Property Fund allows the Fund to take over the management of the state-owned property after a court decision.\u00a0<\/p>\n

The interdepartmental working group at the Ministry of Economy of Ukraine is responsible for the preparatory work on sanctions development. The NACP conducts comprehensive analytical work to identify individuals or companies cooperating with the aggressor state. The Security Service of Ukraine (SSU) refines the information gathered by NACP specialists, forms an evidentiary base, and compiles dossiers on sanctioned individuals or companies for further investigation. Additionally, it is crucial to work with the SSU to identify collaborators and minimize their hostile influence.<\/p>\n

The NSDC coordinates various government agencies involved in the development of sanctions. The Secretary of the NSDC oversees the implementation of decisions made by the Council.<\/p>\n

What businesses should know?<\/strong><\/p>\n

According to the NACP, businesses can assist the government in implementing effective measures by providing information about activities that fall under sanctions or methods of circumventing sanctions. Moreover, Ukrainian companies now have an opportunity to occupy a niche in the international market previously dominated by russian suppliers. Companies can share information about the type and volume of products they are willing to export to foreign markets. Sharing details and experiences among companies in terms of exiting the russian market can be beneficial in promoting responsible business conduct.\u00a0<\/p>\n

An ongoing challenge is the identification of russian assets that may be hidden behind complex legal schemes.\u00a0For a long time, russia’s strategy has involved so-called corrosive investments aimed not at obtaining commercial benefits but at gaining control over Ukraine’s economy and making it dependent on Russia. This was achieved by acquiring corporate rights of Ukrainian enterprises and promoting their personnel to top management positions.<\/p>\n

The implementation of a sanction policy is another crucial issue. Around six draft laws are registered in the Verkhovna Rada that outline the responsibility and consequences for those who violate sanctions. Thorough completion of this task ensures a fair accountability system for sanction violations.\u00a0<\/p>\n

Digitization and modern technologies<\/strong><\/p>\n

In the context of digitization and transparency of sanction policy, the State Sanctions Register can significantly improve sanction-related activities. While work is underway to develop it, sanction lists should soon be converted to at least an Excel format for greater convenience and speed of use.<\/p>\n

The use of artificial intelligence as an auxiliary tool for analyzing large volumes of information is another topic discussed by participants in the discussion. In the future, modern technologies can aid in processing data for developing new sanctions measures efficiently under time and resource constraints.<\/p>\n

Do sanctions work? This question is actively debated in the Ukrainian and international information space. The participants of the discussion are convinced yes, sanctions do work. Contrary discussions are seen as a result of political propaganda led by Russia, aiming to have these significant restrictions lifted. However, sanctions should be strengthened to reduce the possibility of circumvention.<\/p>\n

Sanction-related work will continue at the Ukrainian and international levels, and responsible businesses can join. After all, the armed forces and sanctions are the main drivers of Ukrainian victory, as emphasized by the Chairman of the NACP at the beginning of the meeting.<\/p>\n
