{"id":481405,"date":"2023-05-26T18:01:31","date_gmt":"2023-05-26T15:01:31","guid":{"rendered":"https:\/\/eba.com.ua\/?p=481405"},"modified":"2023-05-26T18:23:08","modified_gmt":"2023-05-26T15:23:08","slug":"ukrayina-praktyka-zastosuvannya-poryadku-organizatsiyi-ta-vedennya-vijskovogo-obliku-pryzovnykiv-vijskovozobov-yazanyh-ta-rezervistiv","status":"publish","type":"post","link":"https:\/\/eba.com.ua\/en\/ukrayina-praktyka-zastosuvannya-poryadku-organizatsiyi-ta-vedennya-vijskovogo-obliku-pryzovnykiv-vijskovozobov-yazanyh-ta-rezervistiv\/","title":{"rendered":"[:ua]\u0423\u043a\u0440\u0430\u0457\u043d\u0430: \u043f\u0440\u0430\u043a\u0442\u0438\u043a\u0430 \u0437\u0430\u0441\u0442\u043e\u0441\u0443\u0432\u0430\u043d\u043d\u044f &#8220;\u041f\u043e\u0440\u044f\u0434\u043a\u0443 \u043e\u0440\u0433\u0430\u043d\u0456\u0437\u0430\u0446\u0456\u0457 \u0442\u0430 \u0432\u0435\u0434\u0435\u043d\u043d\u044f \u0432\u0456\u0439\u0441\u044c\u043a\u043e\u0432\u043e\u0433\u043e \u043e\u0431\u043b\u0456\u043a\u0443 \u043f\u0440\u0438\u0437\u043e\u0432\u043d\u0438\u043a\u0456\u0432, \u0432\u0456\u0439\u0441\u044c\u043a\u043e\u0432\u043e\u0437\u043e\u0431\u043e\u0432&#8217;\u044f\u0437\u0430\u043d\u0438\u0445 \u0442\u0430 \u0440\u0435\u0437\u0435\u0440\u0432\u0456\u0441\u0442\u0456\u0432&#8221;[:en]Ukraine: Update on enforcement of military duty record keeping and reporting regulations[:]"},"content":{"rendered":"<p><\/p>\n<p>In the first and second quarters of 2023, state authorities started to actively verify employers&#8217; compliance with the requirements of the &#8220;Procedure for Organisation and Maintenance of Military Registration of Conscripts, Persons Liable for Military Service and Reservists&#8221;, which came into effect on 5 January 2023 (&#8220;<strong>Procedure<\/strong>&#8220;), and to hold their managers and other relevant employees liable for breach of obligations under the Procedure.<\/p>\n<p><strong>Key requirements of the Procedure<\/strong><\/p>\n<ul>\n<li>The organisation of military registration record keeping is the responsibility of the company&#8217;s management.<\/li>\n<li>First and foremost, the top manager must do the following, among other things:\n<ul>\n<li>Appoint a person responsible for the organisation and maintenance of the military registration records and for liaison with the relevant Territorial Centre of Recruitment and Social Support (TCR)<\/li>\n<li>Inform all employees subject to military service duty of the &#8220;Rules of Military Registration&#8221; against their personal signature<\/li>\n<li>Notify TCR of changes to the personal data of the employee subject to military service duty within seven days, including if hiring or dismissing such employees<\/li>\n<li>Notify the TCR within seven days from the date of appointment or dismissal of the top manager and\/or of the person responsible for the organisation and maintenance of military registration records<\/li>\n<li>Fulfil many other obligations requiring specific action, the full list of which (mostly record-keeping requirements) includes more than 30 items<\/li>\n<\/ul>\n<\/li>\n<li>Non-compliance with the above or any other requirements of the relevant legislation triggers liability for the\u00a0company&#8217;s management in the form of a fine, the decision on the imposition of which is made by the chief of the relevant TCR.<\/li>\n<\/ul>\n<p>Employer inspections for compliance with the military registration requirements are becoming increasingly frequent and the number of fines being imposed on management is rising rapidly.<\/p>\n<p>We recommend that managers review the full text of the Procedure for a more detailed understanding of its requirements.
