On January 27, 2023, the Cabinet of Ministers adopted Resolution No. 76 on the reservation of military conscripts during mobilization and wartime, which provided, among other things, that enterprises deemed critical for the functioning of the economy and the provision of vital needs of the population during a particular period have the right to reserve 50% of their military conscript employees. Given that, as we can see from the example of European Business Association member companies, most businesses continue to operate and support the economic front, such a quantity is minimally necessary, and for some industries even insufficient, to ensure sustainable business operations.<\/span>\u00a0<\/p>\n<\/div>\n

At the same time, the initial version of Resolution No. 76 did not include deadlines for making decisions on reservations<\/strong>. However, as noted by members of the Association, during discussions before the adoption of Resolution No. 76, representatives of the authorities involved in the reservation process assured that all necessary approvals would be made in the shortest possible time. Despite the procedure established by Resolution No. 76, many enterprises have been unable to make reservations due to the lengthy process of coordinating the submitted lists. At the same time, employees of these enterprises continued to receive a summons from mobilization and social support centers. And there have been cases of mobilization of leading specialists from those companies whose proposals for reserving workers have been under consideration for a long time.\u00a0<\/span>\u00a0<\/p>\n<\/div>\n

Similarly, on April 28, the Cabinet of Ministers adopted Resolution No. 400<\/strong>, which established deadlines of 5 and 10 days for the relevant government agencies to consider and decide on applications for reserving conscripts from businesses.<\/span>\u00a0<\/p>\n<\/div>\n

The European Business Association welcomes such a decision by the Government. However, it is critical now to meet the established deadlines, primarily by representatives of the General Staff of the Armed Forces of Ukraine. According to Association member companies, there are still significant delays in decision-making. Nonetheless, we hope that the prescribed mechanism will eventually work in practice, including the recognition of the corresponding enterprises as critical at the level of regional military administrations, as in some regions, this issue has not yet been regulated in terms of the duration of document consideration – documents are prepared in batches and waves for dozens of enterprises, and this delays the decision-making process for more than a month.\u00a0<\/span><\/p>\n<\/div>\n

As well as, in the context of Resolution No. 400, businesses are questioning whether the new requirements will apply to reservation requests submitted before it comes into force.<\/span><\/p>\n<\/div>\n

Therefore, the European Business Association appeals to the Head of the Office of the President of Ukraine – Andriy Yermak, and the Secretary of the National Security and Defense Council – Oleksiy Danilov, with a request to facilitate compliance by the relevant structures with the norms of Resolution No. 400 of the Cabinet of Ministers of Ukraine and some other proposals aimed at improving the interaction of mobilization and social support centers with businesses.<\/span><\/div>\n
