In December 2019, Law No. 376-IX was adopted. It stipulates that the import\/export of goods containing ozone-depleting or fluorinated greenhouse gases requires a license for the import\/export of controlled substances and goods. The license is issued by the Ministry of Economy of Ukraine in coordination with the Ministry of Environment of Ukraine. For reference, this includes, for example, such devices as heat pumps, air conditioners, refrigeration equipment, etc.<\/p>\n
However, according to information from EBA member companies, there are currently delays in obtaining licenses upon submitted applications. Thus, some companies have not been able to obtain licenses for several months. This creates obstacles for them to fulfilling their obligations to contractors, conduct normal business activities and pay the necessary taxes to the state budget. Moreover, according to information from businesses, similar cases, unfortunately, occur with obtaining other types of licenses.<\/p>\n
Business emphasizes that this situation is unacceptable, especially in the difficult military conditions for the country, when it is necessary not only to maintain but also to develop the economic front. It is necessary to facilitate, not hinder, business activities as much as possible. Therefore, it is crucial, first, to resume the process of issuing licenses. Secondly, it is to simplify the procedures for issuing licenses in general.<\/p>\n
The EBA has repeatedly provided proposals that would simplify and significantly speed up the process of issuing licenses, for example, by eliminating the need to submit documents that are not related to the supply of goods for which the License is obtained and which are currently required and reviewed by lawyers of the Ministry of Economy (for example, foreign economic contracts with all their annexes, which in practice forces companies to either submit thousands of pages of documents or re-sign contracts with their headquarters for each delivery). Moreover, the information required to obtain the Licenses, such as prices, import customs, and exact specifications of the goods, is actually irrelevant to the essence of the license itself, which is to report on the number of controlled substances imported into Ukraine.<\/p>\n
Therefore, the European Business Association appeals to the First Vice Prime Minister of Ukraine – Minister of Economy of Ukraine Yulia Svyrydenko and Minister of Environmental Protection and Natural Resources of Ukraine Ruslan Strilets with a request to facilitate the acceleration of issuing licenses for submitted applications and simplify the license issuance system in general. The work of absolutely every company is significant for the country – this has been repeatedly emphasized by representatives of the Ministry and, particularly, by the Ministers. Therefore, it is essential to demonstrate this in word and deed!<\/p>\n
