On February 28, the European Business Association met with representatives of the State Labor Service of Ukraine to discuss topical issues of subsoil users.<\/p>\n
During the meeting, Deputy Head of the State Labor Service Yarema Dul assured the business community of his readiness to cooperate, continue a constructive dialogue, and improve the activities of the supervisory authority.<\/p>\n
Pursuant to the requirements of Law No. 2805-IX “On Amendments to Certain Legislative Acts of Ukraine on Improving Legislation in the Field of Subsoil Use” of December 1, 2022, subsoil users are obliged to inform the State Labor Service of Ukraine about their mining development plans. Regulations on the procedure for informing and confirming are already being developed by the State Labor Service of Ukraine. Thus, it is expected that the information will be provided in writing or electronically at the option of the company. In case of adjustments to the mining development plans, such notification will be mandatory and will be declarative in nature, as provided for by Law No. 2805-IX. As part of the digitalization of the agency, it is also planned to introduce the option of issuing permits or approving technical documents in electronic form.<\/p>\n
The meeting participants were informed that prior to the entry into force of Law No. 2805-IX “On Amendments to Certain Legislative Acts of Ukraine on Improving Legislation in the Field of Subsoil Use” of December 1, 2022, all subsoil users must agree on mining development plans for the first quarter of 2023 in order to carry out their activities in full.<\/p>\n
An equally important part of the activities of the State Labor Service is the regulatory area, which is developing amendments to Ukrainian legislation on subsoil use to replace outdated regulations. Thus, the Order of the Ministry of Economy of Ukraine “On Approval of Safety Rules in the Oil and Gas Industry” is due to be adopted soon.<\/p>\n
The State Labor Service also informed that all issued acts on granting mining allotments after the entry into force of Law No. 2805-IX will be valid until the expiration of the relevant special permits for subsoil use. There is no separate procedure for revoking these acts.<\/p>\n
We are also grateful to the experts of the State Labor Service of Ukraine – Artur Demchenko, Deputy Head of the Mining Supervision Department, Head of the Mining Supervision Department, Blasting and Ammunition Disposal, and Oleksandr Hetman, Chief Specialist of the Geological Surveying Department of the Mining Supervision Department, who professionally answered all questions from the business and supported the importance of the service’s prompt response to market participants’ requests.<\/p>\n
