{"id":437927,"date":"2022-10-11T17:47:07","date_gmt":"2022-10-11T14:47:07","guid":{"rendered":"https:\/\/eba.com.ua\/?p=437927"},"modified":"2022-10-11T17:55:59","modified_gmt":"2022-10-11T14:55:59","slug":"nabrav-chynnosti-zakon-shhodo-zahystu-investytsij-u-neruhomist-yaka-bude-zbudovana-u-majbutnomu","status":"publish","type":"post","link":"https:\/\/eba.com.ua\/en\/nabrav-chynnosti-zakon-shhodo-zahystu-investytsij-u-neruhomist-yaka-bude-zbudovana-u-majbutnomu\/","title":{"rendered":"[:ua]\u041d\u0430\u0431\u0440\u0430\u0432 \u0447\u0438\u043d\u043d\u043e\u0441\u0442\u0456 \u0437\u0430\u043a\u043e\u043d \u0449\u043e\u0434\u043e \u0437\u0430\u0445\u0438\u0441\u0442\u0443 \u0456\u043d\u0432\u0435\u0441\u0442\u0438\u0446\u0456\u0439 \u0443 \u043d\u0435\u0440\u0443\u0445\u043e\u043c\u0456\u0441\u0442\u044c, \u044f\u043a\u0430 \u0431\u0443\u0434\u0435 \u0437\u0431\u0443\u0434\u043e\u0432\u0430\u043d\u0430 \u0443 \u043c\u0430\u0439\u0431\u0443\u0442\u043d\u044c\u043e\u043c\u0443 [:en]Law protecting investment in future residential real estate comes into effect[:]"},"content":{"rendered":"<p><\/p>\n<p>On 10 October 2022, Law of Ukraine No. 2518-IX &#8220;On guaranteeing property rights to real estate to be constructed in the future&#8221; (&#8220;<strong>Law<\/strong>&#8220;) came into effect.<\/p>\n<p>Originating from draft bill No. 5091, which had been under discussion since February 2021, and finally made into law by Parliament on 15 August 2022, this Law aims to offer more protection to those who invest in future real estate.<\/p>\n<p><strong>Highlights<\/strong><\/p>\n<p>The Law intends to secure the rights of investors in real estate (particularly residential real estate) on the primary market by introducing different measures described in more detail below.<\/p>\n<p>A major change is that from now on, funds may be raised for real estate construction only if a special property right to the property under construction, as well as to the future real estate objects therein, is registered in the State Property Rights Register.<\/p>\n<p><strong>Detailed overview<\/strong><\/p>\n<p>The Law envisages, among other things, the following novelties:<\/p>\n<ul>\n<li>The concept of a future real estate object &#8211; a future real estate object is defined as a part of property under construction, which after the commissioning will become a separate real property item (apartments, other residential or non-residential premises, parking lots, etc.).<\/li>\n<li>From now on, the sale of future real estate objects to investors will be possible only after the developer obtains all the necessary construction permits and ensures the state registration of a special property right to all future real estate objects in a property under construction.<\/li>\n<li>Developers must reserve the so-called &#8220;guaranteed share&#8221; of future real estate objects. Alienation of such guaranteed share will not be possible until a property is commissioned.
