<\/span>\n\n\t<\/div>\n<\/div>\nOn November 30, EBA member companies met with Dmytro Zaruba, the new head of the State Environmental Inspectorate of Ukraine.<\/p>\n
During the meeting, the business raised key issues of concern. Thus, the inspectors go beyond the scope of power at different stages of the inspection \u2013 when conducting it and then preparing acts on the results of the inspection, filing claims for damages, fines, etc. Representatives of the State Environmental Inspectorate noted that from next year control measures will be carried out with video recording. Thus, environmental inspectors will be provided with video recording devices. Meanwhile, the procedure for using the received records, providing access to them, etc. has not yet been regulated.<\/p>\n
The issues of inspections based on citizens’ appeals were also touched upon. The companies drew attention to the increase in the number of controversial applications, for example, when it comes to the unbearable smell of emissions from the company, located hundreds of kilometers from the applicant\u2019s place of residence, and so on. In addition to increasing the number of unscheduled inspections at companies, this also leads to a significant overload of public authorities due to the need to consider and respond to all these applications.<\/p>\n
The EBA member companies paid special attention to the issues of interaction of the State Environmental Inspectorate with the Special Prosecutor’s Office. According to Mr. Zaruba, draft law \u21163091 on state environmental control proposes to include law enforcement appeals as a basis for environmental inspection. Besides, the plan is to approve the order of the Prosecutor General’s Office on the procedure for cooperation between law enforcement and regulatory agencies.<\/p>\n
The business community also informed about the practice of publishing information about inspections on their social media pages at a time when the inspection has not yet been completed or if the order is being challenged in court. As a result, such public information becomes the basis for the State Bureau of Investigation to inspect the company. According to the head of the State Environmental Inspectorate, all employees undergo general training and ethics instruction before going for inspections. At the same time, he promised to carry out explanatory work with the team on ethical principles, including the rules of use of private pages and asked to provide information on such cases.<\/p>\n
