On October 26, the European Business Association joined the round table “How to overcome the crisis in the field of private copying and reprography”, which took place in UkrInform.<\/span><\/p>\n\t

\n\t\t\t\tToday, communication on the deductions from gadgets charged for so-called private copying or its hypothetical possibility, has actually reached a stalemate. On the one hand, the lack of transparency in the distribution of funds is the one to blame, as well as total distrust in the collective management organizations, one of which has already been deprived of accreditation to collect funds from gadget manufacturers by the court.\n\t\t\t<\/blockquote>\n\t\t\t\t\n\t<\/div>\n\n

On the other hand, even when there were negotiations with the CMOs on the list of gadgets and the amount of fees to be deducted, the parties could not find a common position either on the list of gadgets subjected to deductions or on the amount of deductions.<\/span><\/p>\n

Thus, the CMO representatives insisted that tariffs should be significantly increased 3-4 times and brought in line with European ones. However, gadget manufacturers and importers insisted that the legal requirement that objectivity and economic feasibility should be taken into account when determining the amount of the fee.<\/span><\/p>\n

Thus, the study of the Kyiv School of Economics, which was presented during the round table by\u00a0<\/span>Ihor Desan<\/span><\/strong>, a senior analyst at the KSE Macroeconomic Modeling Center, is the first and currently the only\u00a0<\/span>economic<\/span><\/strong>\u00a0study of the real content-copying behavior of Ukrainians and its harm to copyright owners. The study includes an original methodology that allowed to calculate the economically feasible tariffs that consider the current state of the country’s economy and consumer behavior of Ukrainians. Therefore, if negotiations with the CMOs resume, the parties will have an economically feasible starting point.<\/span><\/p>\n

Another key aspect that would allow the payment of fees for private copying and reprographic reproduction to emerge from the crisis should be the legislative settlement of the issue. In particular, the participants of the round table repeatedly drew attention to the need to adopt\u00a0<\/span>draft law 4537<\/span><\/a>, which will solve the problem of transparency in distributing fees. Thus, the document stipulates that accredited CMOs must have an information system that will allow online tracking of the amount of funds raised, criteria and methodology for their distribution among authors, and the amount of funds received by each author. That is, it will add transparency to the situation.<\/span><\/p>\n

Therefore, we hope that the position of the business community will be taken into account, and the crisis in the field of payment of copyright fees will finally be overcome.<\/span><\/p>\n
