The document envisages a comprehensive reform of the permitting system and the establishment of new strict standards to control the impact of enterprises on the environment.<\/p>\n<p>According to this draft law, there will one integrated permit that replaces all other permits for waste management, special water use, and air emissions. Such a permit will be issued with the consideration of the fact that the enterprise has applied the best available technologies and management methods (BAT).<\/p>\n<p>Thus, BAT is one of the key elements in reforming the permitting system in the field of industrial pollution and is developed based on the characteristics of industrial sectors, environmental impact, and economic feasibility of their implementation.<\/p>\n<p>At the same time, the draft resolution on the BAT conclusions procedure and the list of activities for which the BAT conclusions are planned to be implemented has not been published yet. Thus, we have a draft reform without clear mechanisms for its implementation. According to the business community, predictability and systematic planning are obligatory for the continuation of economic activity, especially during the economic downturn caused by the pandemic.<\/p>\n<p>An integrated approach to industrial pollution reform, which includes the simultaneous elaboration of a draft law and the BAT list, will provide solutions to <strong>the following key issues<\/strong>:<\/p>\n<ul>\n<li>assessing the validity of the terms for introducing the new permitting system proposed by the draft Law with the consideration of the financial resources necessary for the implementation of the BAT requirements;<\/li>\n<li>accelerating the development and ensure proper public discussion and adoption of the necessary bylaws (BAT conclusions) in the preparation of the draft law;<\/li>\n<li>identifying sources of funding for the implementation of BAT by each industry;<\/li>\n<li>conducting proper training of permitting staff, who must have sufficient expertise to properly assess the application for an integrated permit and other necessary documents and determine the need to eliminate deficiencies and bring them into line with the requirements of the draft law within the prescribed time.<\/li>\n<\/ul>\n<p>The EBA experts appeal to the Ministry of Environment to submit a BAT list for public discussion.
