{"id":243757,"date":"2020-02-11T08:00:59","date_gmt":"2020-02-11T06:00:59","guid":{"rendered":"https:\/\/eba.com.ua\/?p=243757"},"modified":"2020-02-14T11:17:32","modified_gmt":"2020-02-14T09:17:32","slug":"sudova-reforma-nova-rol-praktyky-verhovnogo-sudu","status":"publish","type":"post","link":"https:\/\/eba.com.ua\/en\/sudova-reforma-nova-rol-praktyky-verhovnogo-sudu\/","title":{"rendered":"[:ua]\u0421\u0443\u0434\u043e\u0432\u0430 \u0440\u0435\u0444\u043e\u0440\u043c\u0430: \u043d\u043e\u0432\u0430 \u0440\u043e\u043b\u044c \u043f\u0440\u0430\u043a\u0442\u0438\u043a\u0438 \u0412\u0435\u0440\u0445\u043e\u0432\u043d\u043e\u0433\u043e \u0421\u0443\u0434\u0443[:en]Judicial Reform: New Role of the Supreme Court Case Law[:]"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>On 8 February 2020<\/strong>, the changes to the procedural codes became effective, significantly increasing the role of the Supreme Court case law in the reconsideration of court decisions in Ukraine.<\/p>\n<p><strong>What\u2019s new?<\/strong><\/p>\n<p>Previously, the decision on merits could be challenged with the Supreme Court in the event of breach of substantive or procedural law.<\/p>\n<p>Now, in addition to that, when filing the cassation complaint the claimant shall also prove one of the following:<\/p>\n<ul>\n<li>the lower court when rendering a challenged decision failed to take into account the relevant position of the Supreme Court on the application of substantive law<\/li>\n<li>although the lower court took into account the relevant position of the Supreme Court as explained above, there is a need to depart from such position of the Supreme Court<\/li>\n<li>there is no relevant position of the Supreme Court on the application of substantive law\u200b<\/li>\n<\/ul>\n<p>Failure to prove the above shall prevent the cassation proceedings.<\/p>\n<p><strong>Impact<\/strong><\/div>\n<p>The new regulations set a higher threshold for challenging the decisions with the Supreme Court, which in many cases shall reduce the review of the court decisions to the appellate stage only.
