  On December 8, 2015 the Parliament of Ukraine (VRU) adopted the Draft Law #2558a “On amendments to certain legislative acts of Ukraine regarding deregulation in agriculture” (Draft #2558a). The European Business Association (EBA) has repeatedly emphasized that our state elected European vector of the existence of quarantine permission (for import or transit) (QP) is an unnecessary barrier because the procedure for obtaining the QP in Ukraine is quite bureaucratic. For QP processing, business entities spend plenty of time, while validity period (for short-term) of the QP - from one to six months - and the need to identify the specific point of entry of imported cargo, significantly complicates the logistics and business processes when raw materials for production need to be rapidly delivered. To date, while imported goods are accompanied by the original phytosanitary certificate of the country of departure, the destination customs performs phytosanitary control. Therefore, the EBA welcomes adoption of the Draft #2558a and considers it as an important step towards deregulation of the business sphere in Ukraine that simplifies the import of food products of plant origin and prevents the emergence of corruption risks. We are grateful to the Ministry of Agrarian Policy and Food of Ukraine, members of Parliament for their assistance and affirmative outcome, and our member companies for their initiative and expertise! Legal background: According to the results of the Twinning project “Assistance to Ukraine in the approximation of legislation on phytosanitary and administrative framework in line with European standards”, which was conducted during 2012-2014 to bring Ukrainian phytosanitary standards in line with European law, EU experts recommended cancelling the QP as being nonexistent in the EU. On August 31, 2015 in the VRU the Draft Law #2558a “On amendments to certain legislative acts of Ukraine regarding deregulation in agriculture” (Draft #2558a) was registered. On December 8, 2015 the Draft #2558a was adopted in general. This legislative initiative amends the Law of Ukraine “On plant quarantine” #3348-XII dd. 30.06.1993, which, among other things: - abolishes the need to obtain the QP; - introduces a mechanism for exchange of information between the State Food Service and the State Fiscal Service of Ukraine on existing prohibitions on the import of regulated objects out of quarantine areas.
