Amendments to Technical Regulations on Radio and Telecommunications Terminal Equipment Due to the efforts of the Consumer Electronics Committee of the European Business Association, the Resolution “On Amendments to paragraph 16 of the Technical Regulations on Radio and Telecommunications Terminal Equipment” №181 dated 8 April 2015 (Resolution №181) that amends them in accordance with the requirements of the Law “On Radio Frequency Resource of Ukraine” was adopted by the Cabinet of Ministers of Ukraine. Background: In April 2014 the Law “On Amendments to Certain Legislative Acts of Ukraine on Reduction of the Number of Permit Documents” №1193-VII dated 9 April 2014 (the Law №1193-VII) was adopted. Law №1193-VII cancelled import permits for radio electronics and changed the register of allowed radio electronics in the territory of Ukraine into a register of forbidden radio electronics in the territory of Ukraine. At the same time, the abovementioned requirements still existed in paragraph 16 of the Technical Regulations on Radio and Telecommunications Terminal Equipment (the Technical Regulations). The EBA Consumer Electronics Committee actively supported the necessity to amend the Technical Regulations in accordance with the requirements of Law №1193-VII and the cancelation of the provisions in the Technical Regulations that provided additional financial or administrative burdens on the business community in Ukraine in general. The Committee experts proposed additionally amending paragraph 17 of the Technical Regulations and to foresee the possibility to provide to consumers so-called “informal statements” on the equipment’s compliance with the requirements of the Technical Regulations instead of the obligation to provide a Declaration of Conformity with each equipment’s sample. Unfortunately, this initiative was not solved in the framework of Resolution №181. At the same time, we support the adoption of Resolution №181 in general and are grateful to all EBA members who supported and contributed to our lobbying efforts that resulted in this success. On the other hand, we will continue our activities aimed at creating a business friendly environment in the sphere of radio technologies in Ukraine.
