  Thanks to the efforts of business community, in particular the EBA Wine and Spirits Committee, the licensing of production and trade of alcoholic beverages remains unchanged. Background: The original wording of the Draft Law “On Licensing certain of certain economic activities” № 0934 registered in the Parliament on 27 November 2014 (hereinafter - the Draft Law) provided that business involved in the production and sale of alcoholic beverages and tobacco products wouldbe regulated by a special law. Namely the special law for such activities is the Law of Ukraine On state regulation of production and turnover of ethyl spirit, cognac and fruit spirits, alcoholic beverages and tobacco products №481/95 - dated 19 December 1995. This law establishes specific requirements for the production and trade of alcoholic beverages, through a regulatory body and allows for sanctions in case of violation of the rules. However, provisions on such special legislation of licensing activities relating to alcohol were excludedfrom the Draft Law’s version suggested for the second hearing in the Parliament. Members of the EBA Wine and Spirits Committee alerted MPs to the specificity of the alcohol market and the necessity that licensing activity must take place in accordance with the established special law. The EBA is pleased to announce that the proposal of the EBA Wine and Spirits Committee was included in the Draft Law’s second reading by MP Roman Nasirov and the Law was adopted on 2 March 2015. We would like to express our gratitude to all MPs for their adoption of Law №222-VIII and for preserving the existing rules in the licensing of alcoholic beverage production and trade.
